146 Deputy Emmet Stagg asked the Minister for Justice, Equality and Law Reform the investigation that has been held into the release in error of a prisoner serving a six year sentence in mistake for another prisoner of the same name; the outcome of such investigation; if changes have been introduced to procedures to ensure that a similar error is not made in the future; and if he will make a statement on the matter. The incident referred to by the Deputy occurred in Mountjoy Prison in June, 2007. This prisoner was returned to custody by Gardaí at the end of August 2007. His release date has been adjusted accordingly.

Following an investigation by the Governor of Mountjoy Prison, disciplinary procedures have been initiated against a number of staff under the Code of Discipline. The Deputy will therefore appreciate that I am precluded from commenting further at this time in relation to this matter.

I can confirm that a Governor's Order which sets out the correct procedures to be followed in the case of prisoner releases was re-issued to all staff in Mountjoy Prison.

147 Deputy Ciarán Lynch asked the Minister for Justice, Equality and Law Reform if the Garda Superintendent appointed to carry out an investigation into the circumstances in which the Gardaí failed to act on information supplied through Interpol from the Austrian authorities regarding the alleged involvement of people based here in a global child pornography ring has been concluded; if it is intended to publish the report; and if he will make a statement on the matter. I am informed by the Garda authorities that the investigation into this matter is ongoing and nearing completion. The Deputy will appreciate that it would be inappropriate for me to comment further at this time.
