In the current financial environment the Health Service Executive (HSE) is facing a challenge to deliver services in a way that will minimise any adverse impact on patients and continue to protect, as far as possible, the most vulnerable citizens. Unfortunately, it has become necessary for the HSE to suspend certain products from its list of reimbursable items, including gluten-free products.

The gluten-free products have become more widely available in supermarkets in recent years and tend to be significantly cheaper than products sold through community pharmacies. A Supplementary Welfare Allowance Adult Diet Supplement may be awarded by the Department of Social Protection to eligible persons. Persons wishing to apply for this allowance can do so by completing an application form which can be downloaded at: www.welfare.ie/EN/Forms/Documents/swa9.pdf. Separate application forms are available for children.

For persons who are not awarded a Diet Supplement, moneys spent on gluten-free foods can be taken into account for tax purposes.

The Health (Pricing and Supply of Medical Goods) Bill 2012 will introduce a system of reference pricing and generic substitution for prescribed drugs and medicines. These reforms will promote price competition among suppliers and ensure that lower prices are paid for these medicines resulting in savings for taxpayers and patients.

The Bill is a Government priority for this session. It has completed its passage through the Seanad and will be debated in this House shortly. It is not possible, at this juncture, to provide accurate figures regarding potential savings resulting from the Bill, as this depends on various factors. Negotiations are ongoing between officials of the Department/HSE and the two bodies that represent pharmaceutical manufacturers here regarding reductions in the price of medical products supplied under State Schemes. It is expected that these negotiations will conclude shortly and provide significant savings in the cost of medicines.

The Local Improvements Scheme provides funding for private roads and the maintenance and improvement of these roads is, in the first instance, a matter for the relevant landowner. The feasibility of providing funding to assist with maintenance of private roads will be reviewed in the context of the monies available under the 2013 grant allocations for regional and local roads.

Road Traffic Offences

698. Deputy Robert Dowds asked the Minister for Transport; Tourism and Sport if he will outline the law regarding driving a vehicle while under the influence of illegal drugs. [42820/12]

It is illegal to drive while under the influence of drugs to such an extent as to be incapable of having proper control of the vehicle.   Section 4 of the Road Traffic Act 2010 prohibits the driving of a vehicle while under the influence of an intoxicant to this extent. An intoxicant is defined in the Act as including alcohol and drugs and any combination of drugs and alcohol.

Enforcement of the law on drug driving is a matter for the Garda Síochána.  When a member of the Gardaí suspects that a motorist is driving under the influence of any intoxicant, the Garda may arrest the suspect under Section 4.  Following arrest, an evidential sample of blood, urine or breath is taken and this is tested for alcohol content/presence of drugs by the Medical Bureau of Road Safety.  The Bureau issues certificates in respect of these analyses, which may be used as evidence in prosecutions for drug driving as appropriate.

The Government has no specific plans for a diaspora centre in Dún Laoghaire. A special working group, established by Fáilte Ireland, has considered the concept of a diaspora centre. It is proposed to tender for options in the coming months. The centre might not necessarily be a new building or museum. It could also be an online project or be accommodated in an existing institute.

Dún Laoghaire Harbour Company is a commercial State port company. While my Department has oversight responsibility for the corporate governance of the port company, staffing and pay issues are an operational matter for the company, in which I have no function.

I have referred the question to Dún Laoghaire Harbour Company for direct reply to the Deputy. If he does receive a response within ten working days, please contact my private office. It is existing Government policy that port companies are commercial entities that are required to fund capital investment without recourse to the Exchequer.

Following the establishment of the National Transport Authority (NTA) on 1st December 2009, the provision of infrastructure projects in the Greater Dublin Area (GDA), such as LUAS BXD, now comes under the remit of the NTA. LUAS BXD to Broombridge was designed to be a key element in an overall  integrated transport network for Dublin.  It will create a LUAS network by joining the LUAS Red and Green Lines and will also link with  rail services from Maynooth and Dunboyne and with  existing Quality Bus schemes which enter or cross Dublin City Centre. It will also in time interchange with future key projects such as Dart Underground and Metro North.

The project has been prioritised under the Governments's 5-year capital plan - Infrastructure & Capital Investment Programme 2012-2016 - Medium Term Exchequer Framework - which was published in November 2011. 

An Bord Pleanála gave approval to the project on 2nd August 2012 and following the statutory 8-week appeal period the railway order (RO) is now operational. I understand that the business case for the project is now being updated by the Railway Procurement Agency having regard to conditions attached to the RO and other information updates.

Funding has been included in my Department's capital allocation to 2016 to cover the cost of commencing the main construction works in 2015 and for pre-construction enabling works in 2013 and 2014.  Construction is expected to take 4 years. The overall cost of the project is anticipated to be in the region of €368 million. It is not possible to provide a breakdown of the various elements of the scheme at this stage.

The improvement and maintenance of regional and local roads in its area, is a statutory function of each road authority in accordance with the provisions of section 13 of the Roads Act, 1993.  Works on such roads are a matter for the relevant local authority to be funded from its own resources supplemented by State road grants. I understand that this scheme is approximately 70% complete and is on track to open in Quarter 1/Quarter 2 of 2013.

As I have previously stated the situation which arose is most unfortunate and came about from the failure of the Pilot Training College (PTC), a privately-owned and operated flight training school, to meet its contractual obligations to its students in relation to the completion of their training.

The Irish Aviation Authority (IAA) has responsibility for approving and overseeing flight training organisations in Ireland.  The Authority’s primary functions in this regard are the oversight of the safety, quality and standard of the training being delivered, the conduct of examinations and flight tests.  They look at whether the company has sufficient resources to safely provide the training required to the internationally determined standards.  They have no involvement in, or responsibility for, the contractual arrangements between flight schools and their students.  The regulation of Flight Training Organisations which is carried out by the IAA is based on European and International rules and standards and the IAA conducts its activities in this regard in the same manner as in other States where these common rules and standards apply.  Unfortunately PTC is not an isolated example; in recent years a number of flight schools in other jurisdictions, including in the UK, have collapsed as the global economic downturn deepened.

While I have considerable sympathy for those facing personal financial loss, there are likely to be a significant number of creditors in this case including foreign students, airlines and other suppliers and these will be dealt with in the normal manner under company law following the order of the High Court for company to be wound up. Almost all companies in the State are regulated or licensed by the State or a State agency or body and this fact does not confer liability on the State for the debts incurred by the companies.

In March of this year the Government published the first Annual Report setting out progress on the Programme for Government commitments during its first year in office. It  is the Government's intention to publish a second annual report next March which will set out specific progress on implementation during the second year. The status of each of the commitments for which I have specific responsibility is set out below.  

Commitment Progress

Abolish the Travel Tax as part of a deal with airlines to restore lost routes

 

International access is vital to tourism recovery. We will abolish the €3 travel tax subject to a deal being agreed with Ryanair and Aer Lingus to re-open closed routes and bring more tourists into Ireland. If no deal can be done, there will be no reduction in the tax.

We will prioritise the Tourism Marketing Fund as an essential pillar of our tourism strategy and will ensure the best return on Exchequer spending.
