Carer's Allowance Appeals

100. Deputy James Bannon asked the Minister for Social Protection the position regarding and appeal on a carer's allowance in respect of a person (details supplied) in County Longford [46742/12]

The Social Welfare Appeals Office has advised me that an appeal by the person concerned was registered in that office on 23rd August 2012. It is a statutory requirement of the appeals process that the relevant Departmental papers and comments by the Deciding Officer on the grounds of appeal be sought. When received, the case in question will be referred to an Appeals Officer who will make a summary decision on the appeal based on documentary evidence presented or, if required, hold an oral hearing. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.

The Social Welfare Appeals Office has advised me that an appeal by the person concerned was registered in that office on 2nd April 2012. It is a statutory requirement of the appeals process that the relevant Departmental papers and comments by or on behalf of the Deciding Officer on the grounds of appeal be sought. These papers were received in the Social Welfare Appeals Office on the 11th July 2012 and the case has been referred to an Appeals Officer who will make a summary decision on the appeal based on documentary evidence presented or, if required, hold an oral hearing. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.

Disability Allowance Appeals

An application for disability allowance was received from the person concerned on the 2 December 2011. This application was referred to one of the department's medical assessors who found that the person was not medically eligible for disability allowance. A letter issued on 2 May 2012 advising of this.

The Social Welfare Appeals Office has advised me that an appeal was lodged by the person concerned on 19 June 2012. As part of the person's appeals process, the department referred all the medical evidence received to a second medical assessor for review. When the deciding officer receives the opinion of the medical assessor, which is expected shortly, a decision will be made. If, following this review, the decision to refuse the payment stands, the appeal and all relevant papers will be referred to the Social Welfare Appeals Office who will decide whether the case should be determined on a summary basis or by oral hearing.

I am advised by the Social Welfare Appeals Office that an Appeals Officer having fully considered all the available evidence allowed the appeal of the person concerned by way of summary decision. The person concerned has been notified of the Appeals Officer decision. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.

I confirm that the department received an application for carer's allowance from the person in question on the 21st July 2011. This application was referred to one of the Department's Medical Assessors who found that the caree in question was not medically eligible for carer's allowance. It was also found that the full time care and attention criterion was not satisfied. A letter issued on the 28th of March 2012 notified the person concerned of this decision, the reasons for it and of her right of review or appeal. The person concerned appealed this decision to the Social Welfare Appeals Office and submitted further medical evidence in support of the appeal. This information was forwarded to the medical assessor for further consideration on the 9th of July 2012. If the outcome remains unchanged a submission will be prepared and her file and papers will be forwarded to the Social Welfare Appeals Office for determination.

Invalidity Pension Appeals

Invalidity pension is a payment for people who are permanently incapable of work because of illness or incapacity and who satisfy the contribution conditions. This department received a claim for invalidity pension for the person concerned on 24 May 2011. The medical evidence provided by the claimant in support of her claim was examined by a medical assessor who was of the opinion that the person concerned is not eligible for invalidity pension as she does not satisfy the medical criteria. The application for invalidity pension was disallowed by a deciding officer. The person in question was notified of this decision and the reason for it on 11 January 2012.

Further medical evidence was subsequently submitted by the claimant. This additional evidence, along with the original information, was evaluated by a different medical assessor who also expressed the opinion that the person concerned does not satisfy the medical criteria. Accordingly, the deciding officer has confirmed the original decision and the claimant was notified of the outcome on 26 June 2012.

The person concerned has appealed the decision and has, again, submitted further medical evidence which has been forwarded to a different medical assessor for evaluation. If following this review she still does not satisfy the medical criteria, her file and a submission will be forwarded to the independent Social Welfare Appeals Office for determination. If the claimant satisfies the medical criteria, a revised decision will be made on her application by a deciding officer and she will be notified directly of same.
