149. Deputy Bernard J. Durkan asked the Minister for Social Protection the reason the habitual residency clause is being used to deprive social welfare payment in the case of a person (details supplied) in County Kildare; if payment will be approved in view of the fact that they are an EU national; and if she will make a statement on the matter. The person concerned was disallowed a weekly supplementary welfare allowance payment on the grounds that she is not considered to satisfy the habitual residency condition. The person concerned can appeal this decision to the Social Welfare Appeals Office.
