Disadvantaged Areas Scheme Appeals

181. Deputy Patrick O'Donovan asked the Minister for Agriculture, Food and the Marine the position regarding a derogation appeal in relation to 2012 disadvantaged area scheme in respect of a person (details supplied) in County Donegal and when a decision will issue; and if he will make a statement on the matter. While the person named appealed to the DAS Appeals Committee, he was among a high percentage of applicants who submitted supporting documentation with their appeals which had not previously been submitted to my Department. This necessitated further examination by my Department before the necessity to refer the appeals in question to the Appeals Committee could be confirmed.

In this case, the additional documentation was sufficient to allow the appeal. Accordingly, processing of the 2012 Disadvantaged Areas Scheme application was recently finalised, and payment will shortly issue to the nominated bank account.

Payment under the 2012 Disadvantaged Areas Scheme has not yet issued as, at this stage, the holding concerned has not yet satisfied the Scheme minimum stocking density requirements for 2012. An exercise to take account of December 2012 data, which has recently become available, is currently ongoing and is scheduled to be completed before the end of January, thereby establishing the definitive position of the holding of the person named and other similarly affected scheme applicants. Should that re-validation confirm that the holding has satisfied the Scheme requirements, the case will be further processed with a view to payment issuing at the earliest possible date thereafter.

The holding of the person named was recently confirmed as having satisfied the minimum stocking density requirements of the 2012 Disadvantaged Areas Scheme. Accordingly, processing of the application has been finalised, and payment will shortly issue to the nominated bank account.

An application was received from the person named on 3rd March 2012.

In order to comply with EU requirements, the applicant was one of a number selected for inspection. The outcome of the inspection process is that there will not be any reduction in the herd-owner’s eligible land.

Payments due under the Single Payment Scheme / Disadvantaged Areas Scheme/Grassland Sheep Scheme will shortly issue to the nominated bank account.

The appeal of the person named is currently being examined by my Department. There are issues involved relating to rights to commonage land and the permanent division of commonage land. These matters are complex and require extensive research of historical documentation. My Department will complete this review as quickly as is possible and the applicant will be informed of the outcome as soon as it is completed.

Agri-Environment Options Scheme Payments

Deputy Éamon Ó Cuív asked the Minister for Agriculture, Food and the Marine the reason agri-environment option scheme and REP scheme farmers who had a change in area farmed as result of an inspection in 2012 have not received their payments; and if he will make a statement on the matter. Both the Agri-environment Options Scheme and the Rural Environment Protection Scheme are implemented under the Rural Development Programme, 2017-2013, and are subject to EU Regulations which require detailed administrative checks on all applications to be completed before any payments can issue. These checks have commenced and payments under both schemes have commenced in respect of the 2012 scheme year. My Department is continuing to process all applications for payment on an ongoing basis with a view to completing all payments as quickly as possible, including those cases where additional processing is required to take account of reductions in the areas farmed as result of inspections in 2012.

The person named commenced REPS 4 in June 2008 and received payments for the first four years of their contract.

REPS 4 is a measure under the current 2007-13 Rural Development Programme and is subject to EU Regulations which require detailed administrative checks on all applications to be completed before any payments can issue. These checks have been completed and 2012 payments have commenced. The 75% Year 5 payment issued to the person named on 15th January 2013 for the amount of €2671.76. The balancing 25% payment will issue shortly.
