427. Deputy Caoimhghín Ó Caoláin asked the Minister for Social Protection the reason a person (details supplied) in County Cavan has had their appeal refused when the information was provided in terms of their means; if same will be reviewed; and if she will make a statement on the matter. I am advised by the Social Welfare Appeals Office that an Appeals Officer having fully considered all the available evidence, including that adduced at oral hearing, disallowed the appeal of the person. The person concerned was notified of the Appeals Officer’s decision on 1 November 2012. Jobseeker’s Allowance is a means-tested payment. The person concerned failed to provide information/documentation which would allow for review of his means. If the person concerned has additional information, this may be submitted directly to the Department of Social Protection. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
