519. Deputy Tom Fleming asked the Minister for Agriculture, Food and the Marine if he will expedite a single farm payment appeal in respect of a person (details supplied) in County Kerry; and if he will make a statement on the matter. [22380/13]

A review of the original decision on the penalty in this case, which took account of correspondence received from Kerry County Council, resulted in the level of penalty being reduced from 20% to 15%. This decision was notified to the applicant on 8 February 2013 and the additional amount due issued to the nominated bank account on 14 February.

However, this outcome has since been appealed to the Agriculture Appeals Office on 14 March 2013. The request is currently being processed and staff from the Appeals Office, which is independent from my Department, will be in touch with the person named in due course to arrange an oral hearing.
