362. Deputy Bernard J. Durkan asked the Minister for Social Protection the position regarding a review of an appeal in the case of a person (details supplied) in County Kildare; and if she will make a statement on the matter. [25220/13]
View answerThe person concerned was notified in writing by the Social Welfare Appeals Office on 25 February 2013 that an Appeals Officer had reviewed the further medical evidence provided in her case but concluded that his original decision to disallow her appeal should stand. A decision of an appeals officer is final and conclusive in the absence of new evidence or new facts. It is open to the person to reapply for disability allowance if there is any change in her circumstances.
