Road Improvement Schemes

1106. Deputy Derek Nolan asked the Minister for Transport, Tourism and Sport if he will reintroduce the local road improvement scheme for the benefit of roads in rural areas; and if he will make a statement on the matter. [27745/13]

The Local Improvements Scheme provided funding for the maintenance and improvement of private roadways which are, in the first instance, a matter for the relevant landowner. 

State grants available to supplement expenditure by local authorities on the maintenance of regional and local roads have been reduced significantly and there will be further cuts over the next few years.  The scale of the cuts have necessitated that some grant programmes be curtailed or ended.

In making adjustments to the regional and local roads allocations the primary aim has been, as far as is possible, to protect previous investment in the road network and use the  available funding to maintain and restore public roads, including those in rural areas.  Given that priority, it was not possible to provide a separate allocation under the Local Improvement Scheme in 2013. 

Instead this year local authorities have been provided with the opportunity to use up to 7% of their Discretionary Grant on these private roads under the Local Improvements Scheme should they wish to do so, however it is a matter for the Council to prioritise their work programmes and decide if they wish to avail of this flexibility.

Responsibility to develop, procure, implement, operate and maintain the integrated ticketing Leap Card system in the Greater Dublin Area (GDA) became a function of the National Transport Authority (NTA) with effect from 30th September 2010.

North-South Implementation Bodies

Tourism Ireland Limited is the North South body responsible for promoting the Island of Ireland overseas as a tourist destination. The day-to-day work of the Agency is an operational matter for the Agency itself. However, it operates in accordance with decisions on policies and actions taken by the North/South Ministerial Council (NSMC) meeting in Sectoral format.

The Deputy will be aware that tourism was specifically identified in the Good Friday Agreement as one of the key areas for North/South co-operation.

The most recent NSMC meeting in Tourism Sectoral format took place on 28th November 2012 in Armagh. The agenda items included Tourism Ireland's Draft Business Plan for 2013.   The Council also discussed major tourism initiatives including The Gathering Ireland 2013 and Derry-Londonderry UK City of Culture 2013, and noted the major role which Tourism Ireland is playing in their overseas promotion. At the meeting, a paper on the Great Britain market was also discussed.

The next NSMC meeting in Tourism Sectoral format will take place on 26th June 2013 in Armagh.  Amongst the anticipated discussion items will be Tourism Ireland's Annual Report for 2012, a review of the 2013 tourism season to date (including major tourism initiatives North and South) and the tourism prospects for the remainder of 2013 and beyond. 

There is also ongoing co-operation between the tourism agencies and Government Departments north and south in a number of other areas including the selection of suitable tourism projects to benefit from Peace/INTERREG funds, work to harmonise and share tourism statistics north and south and specific initiatives by the agencies in relation to major events such as the Giro d'Italia. I look forward to this work continuing and to availing of any other beneficial opportunities for north/south cooperation in the tourism sector in the future.

The National Transport Authority (NTA) has responsibility for the regulation of the taxi industry under the provisions of the Public Transport Regulation Act, 2009, including responsibility for SPSV licensing requirements and the development and administration of the area knowledge and skills development test.

Details of the regional and local road grant payments to county councils are outlined in the regional and local road grant payment booklets which are available in the Dáil Library.  Details of the 2013 regional and local road grant allocations to each county council are also available in the Dáil library.

With regard to national roads, details of the allocations to each local authority are also available in the Dáil library.  However, details of the actual drawdown of funding for these roads is a matter for the National Roads Authority.

While Section 101B of the Road Traffic Act, 1961, provides for the clamping and/or towing of vehicles by local authorities or their agents on public roads or local authority car parks, there is currently no regulation of clamping companies nor of the activity of clamping on private land. In line with the commitment contained in the Programme for Government to “legislate to regulate the vehicle clamping industry” , the Government recently approved the Heads of the Regulation of Vehicle Immobilisation Bill, which are available on my Department's website.

Under the provisions of this Bill, the National Transport Authority will be given powers to license clamping companies, set clamping-release fees, establish an appeals process and separate complaints procedure, as well as introducing an industry-wide code of practice.

The Bill will be drafted over the coming months in the Office of the Parliamentary Counsel and I hope to  introduce it in the Oireachtas later in the year.

As Minister for Transport, Tourism & Sport, I have responsibility for overall policy and funding in relation to the national roads programme.  The planning, design and implementation of individual road projects, including the purchase of land for such purposes, is a matter for the National Roads Authority (NRA) under the Roads Acts 1993 to 2007 in conjunction with the local authorities concerned.

The Gathering Initiatives

As the Deputy will be aware, the reaction to date on The Gathering Ireland 2013 has been overwhelmingly positive. While we have very much targeted this year, I have no doubt that the pay-off for participation will have longer term positive consequences with many of the events developing into annual traditions and creating on-going connections with other parts of the world. The Gathering 2013 project advisory board has been working with the Gathering 2013 team and the tourism agencies on securing the legacy of the Gathering 2013, to ensure the good work being achieved is continued, and that the outcome of the Gathering continues to have lasting positive benefits.

With regard to the building of a brand Ireland, from a tourism perspective, responsibility for the overseas promotion of Ireland  rests with Tourism Ireland Ltd.  The agency undertakes regular reviews of the brand itself as well as detailed market research in all of our main overseas tourism markets. In terms of the overall brand, the island of Ireland tourism brand was reviewed and refreshed in 2011. As a result, a new three-year global advertising campaign – “Jump into Ireland” – comprising TV, radio, print, cinema and on-line advertisements has been rolling out across the 22 markets in which Tourism Ireland has a presence to an estimated audience of 200 million potential visitors worldwide. The campaign has been developed to be flexible and adaptable and will evolve over its three-year lifespan to capitalise on events such as ‘The Gathering Ireland 2013’.

Tourism Ireland also works closely with the Irish Embassies in all tourism markets and with agencies such as Enterprise Ireland, IDA, Bord Bia, Culture Ireland and the Irish Film Board on projects including St Patrick’s Day, overseas trade missions, and to maximise the tourism potential of Irish food and film. In addition, Tourism Ireland, in conjunction with Fáilte Ireland, the Northern Ireland Tourist Board and the Irish Tourist Industry Confederation (ITIC), established a Tourism Recovery Taskforce during 2011 to further ensure that Ireland is promoted at home and abroad with one strong brand message and a coordinated strategy and action plan involving wide public and private sector participation.

Consumer Protection

The National Consumer Agency, which is under the remit of the Minister for Jobs, Enterprise and Innovation, is responsible for the enforcement of the Consumer Protection Act 2007.  Consumers who have been subject to misleading or unfair practices by car rental companies may make a complaint to the Agency.

In this regard, the Department of Jobs Enterprise and Innovation recently commenced a public consultation on  the implementation of Directive 2011/83/EU on Consumer Rights which must be applied in Member States from 13 June 2014.  As part of the Directive, a trader must seek the express consent of the consumer to any extra fees or charges. If this is not obtained, then the consumer shall be entitled to reimbursement of this payment.  It also requires that information is provided in a clear and comprehensible manner about the ‘total price of the goods or services inclusive of taxes’ and, where applicable, about ‘any other costs’. If the trader has not complied, the consumer will not be required to bear those costs.  My Department will be making observations in the context of the  tourist experience.

Those customers with complaints about their experience should also be aware that the Car Rental Council of Ireland, an industry body which represents the main  car rental companies, operates its own Code of Practice for its members which amongst other commitments states that a member company will "clearly advise the customer of what is included in the price quoted to avoid any charges that might, later on, be perceived by the customer as hidden, unexpected or unfair". 

As the Deputy may be aware, I have no regulatory function in relation to the car rental industry.  However, the tourism agencies under the aegis of my Department have put information on their websites to help make tourists aware of potential issues pertaining to car rental, and to help them avoid charges they may not wish to incur.

Integrated Ticketing

Responsibility to develop, procure, implement, operate and maintain the integrated ticketing system in the Greater Dublin Area (GDA) became the function of the National Transport Authority (NTA) with effect from 30th September 2010 in accordance with section 58 of the Dublin Transport Authority (DTA) Act 2008. In addition, section 63 of the DTA Act 2008 extends the NTA’s remit in relation to integrated ticketing to the rest of the State.
