Since March 2011 a number of new bodies have been established following the merger and rationalisation of other bodies. Under the Public Service Reform plan the following were identified for rationalisation:

The merger of the Irish Research Council for Science, Engineering and Technology & Irish Research Council for the Humanities and Social Science into consolidated single council under HEA;

The amalgamation of Further Education and Training Awards (FETAC), Higher Education and Training Award Council (HETAC) and National Qualifications Authority of Ireland (NQAI) into one body the QQI; and

The reduction of the number of VEC's from 33 to 16.The following actions have been taken to date: The Irish Research Council for Science, Engineering and Technology and Irish Research Council for Humanities and Social Sciences were merged in March 2012 to form the Irish Research Council (IRC). The IRC has been established as a sub-board of the Higher Education Authority (HEA). Under the provisions of the Qualifications and Quality Assurance (Education and Training) Act 2012, the National Qualifications Authority of Ireland (NQAI), the Higher Education Training Awards Council (HETAC) and the Further Education Training Awards Council (FETAC) were amalgamated to form a new agency, the Quality and Qualifications Ireland (QQI) on the 6th November, 2012. In June of 2011, I announced that the Government had approved a revised reconfiguration of the Vocational Education Committees system. The Government decision confirmed that the number of VECs would be reduced to 16. The Education and Training Boards Bill was published on 5th October 2012 and was enacted on 8th May 2013. It is expect that the Education and Training Boards will be established in late 2013. Further Education and training Authority to be called SOLAS. The Further Education and Training Bill was published in January 2012 and is expected to be enacted before the summer recess. Following the enactment of the Residential Institutions Statutory Fund Act 2012, the necessary steps have been taken to dissolve the Education Finance Board in March 2013 and establish the Residential Institutions Statutory Fund Board. This body will be funded from the contributions of the religious congregations offered in response to the request for additional contributions, following the publication of the Ryan Report.

Deputy Derek Keating asked the Minister for Public Expenditure and Reform the current situation in relation to providing a suitable building to facilitate the Department of Social Protection’s plan to open a social welfare office in the Lucan area, Dublin; if his Department will consider renting on a temporary basis a suitable building to facilitate the opening of the social welfare office until or if consideration is being given to building such a facility; and if he will make a statement on the matter. My officials are currently looking for a large public office in the Lucan area as part of the roll out of the new INTREO programme on behalf of the Department of Social Protection. The basic requirement is for centrally located office accommodation of approximately 2,000 square metres with suitable access for public callers. The availability of adequate ground floor space to meet the requirements of a public office is also essential. In March, 2013 the Commissioners advertised for appropriate space in the national newspapers but unfortunately no replies were received. My officials are continuing to look for and evaluate suitable accommodation, but to-date they have not been able to identify any premises that are in a suitable location and of sufficient size to meet these needs.

Deputy Seán Kyne asked the Minister for Public Expenditure and Reform his views on whether there is a conflict of interest between the statutory autonomy of the valuation tribunal and the financial control over the tribunal by the Commissioner of Valuation, the accounting office of the Valuation Office, which is the respondent in all valuation appeals heard by the tribunal. I am not aware of the existence of any possible conflict of interest or of the perception of a conflict of interest between the statutory autonomy of the Valuation Tribunal and the financial control over the Tribunal by the Commissioner of Valuation.

While the Valuation Office is the respondent in all valuation appeals heard by the Tribunal, the Tribunal is independent of the Commissioner and consists of a chairperson, deputy chairpersons and ordinary members who are appointed by the Minister for Public Expenditure and Reform in accordance with the provisions of the Valuation Act 2001.

The conduct of hearings, the appointment of members to the Tribunal and the issuing of judgments are all matters for which the chairperson of the Tribunal is responsible. The procedures of the Tribunal are determined by Rules made by it under the Valuation Act, with the consent of the Minister for Public Expenditure and Reform. The administrative arrangements that support the work of the Tribunal are carried out by a Registrar and a small number (4) of support staff. Since the Tribunal was established in 1988, for administrative efficiency and value for money reasons, the Tribunal is funded as a subhead of the Vote of the Valuation Office and the Commissioner of Valuation is €693,000.00.

As part of the programme of rationalisation of state bodies the Government has decided that the Valuation Office, Ordnance Survey Ireland and the Property Registration Authority are to be merged. The arrangements for the Valuation Tribunal will also be considered in this context.

Heritage Sites

The Office of Public Works (OPW) maintains and operates a range of important visitor heritage sites across the country. 70 of these sites are presented with full Guide Services off which 24 are open all year round, and the remainder for a limited part of the year, mainly between April and October. OPW also operates a number of visitor sites that have free admission but do not have a guided presence and consequently visitor numbers are not recorded at these sites. An example of such a site would be St. Stephen's Green. Visitors to some guided sites are only recorded if they enter the visitor centre of that site. For example, Glendalough monastic site may be accessed freely without entering the visitor centre and being formally recorded.

Figures have been collated therefore on the basis of those OPW visitor sites where a guided service is provided and where visitor numbers are recorded. The 2013 figures have been compiled up to Sunday 26 May. The visitor numbers at each site are shown in tabular statement which has been sent to the Chairman under separate cover.

I am pleased to state that a direct comparison of the total 2011 and 2012 recorded visitor numbers at OPW sites shows an overall increase of nearly 11%.

Section 12 of the Public Service Management (Recruitment and Appointments) Act 2004 provides that the Commission for Public Service Appointments (CPSA) shall comprise 5 ex-Officio members, namely

- An Ceann Comhairle,

- the Secretary General to the Government,

- the Secretary General to the Department of Public Expenditure and Reform,

- the Chairperson of the Standards in Public Office Commission and

- the Ombudsman

The Office of the CPSA has now merged with the Office of the Ombudsman following the enactment of the Ombudsman Amendment Act 2012 and this Act provides that the Director General at the Office of the Ombudsman shall also be the Director to the Office of the CPSA.

As such I have not appointed a director to the CPSA or the Office of the CPSA.

The Department of the Public Service Circular 6/1984 - Private Secretaries and Confidential Clerical Assistants sets out instructions concerning private secretaries and confidential clerical assistants. The circular provides that the persons selected to act as Private Secretary should be drawn from the grades of Executive Officer, Higher Executive Officer or Administrative Officer.

It is my understanding that most, if not all, officials appointed as Private Secretary to a Minister are appointed by way of a lateral transfer of a serving civil servant within the Minister's Department. The Commissioners for Public Service Appointments (CPSA) do not consider the post of Private Secretary to be an appointment as described in the Public Service Management (Recruitment and Appointments) Act 2004. The CPSA plays no role in overseeing the appointments to the post of Private Secretary.

Selection processes for such appointments are usually confined to staff in the Department where the appointment is to be made and run by the Human Resources Unit of that Department. Applications are sought from Higher Executive Officer, Administrative Officer, or Executive Officers who wish to be considered and a shortlist based on a CV or letter of application is drawn up. In general, those who are shortlisted are interviewed by the Minister or Minister of State, as appropriate, and who may be supported in the interview process by the HR Unit. The final decision on appointment will rest with the Minister or Minister of State.

I understand that the Deputy is referring to the Public Service Pension Reduction (PSPR), which at present applies at a rate of 20% on that part of an affected public service pension which is above €100,000.

That 20% PSPR rate is due to rise to 28% on 1 July 2013, reflecting changes made in the Financial Emergency Measures in the Public Interest Act 2013.

I can confirm for the Deputy that it is my intention that holders of multiple public service pensions with a combined value of €100,000 whose pensions are currently subject to PSPR will have PSPR applied to their total public service pension amount, including the application of the 28% rate above €100,000.

This application of PSPR based on combined or aggregated pensions in respect of these pensioners will proceed from a date to be set by order of the Minister for Public Expenditure and Reform as provided for in the Financial Emergency Measures in the Public Interest Act 2010, as amended by the Public Service Pensions (Single Scheme and Other Provisions) Act 2012. I expect to sign an order very soon setting an early commencement date for this aggregation of public service pensions for PSPR purposes.

** The Public Service Management (Recruitment and Appointments) Act, 2004 states that the Minister for Public Expenditure and Reform (in consultation with Minister for the Environment, Community and Local Government, the Minister for Health and the Minister for Justice and Equality) should appoint members of the Board of the Public Appointments Service.

The Board is meant to be representative of our client base. The majority of the board is therefore civil or public servants, nominated by the relevant Minister. There is also a union representative nominated by ICTU. The Minister for Public Expenditure and Reform reappointed the outgoing Chairman and the two external members were appointed because of their expertise in strategic change and public service recruitment respectively.

Two of the above appointments were replacements for two board members who resigned from the Board as a consequence of leaving their positions in the Public Service (i.e. CEO of the Public Appointments Service and National Director of HR in the HSE).

Deputy Andrew Doyle asked the Minister for Public Expenditure and Reform further to Parliamentary Question No. 339 of 11 June 2013 regarding parking in the lower yard of Dublin Castle, the steps that he and his officials are taking to incrementally reduce car parking at the said site until it is discontinued fully; if this process will be done when officials from the Revenue Commissioners, Comptroller and Auditor General's office, Office of Public Works, an Garda Síochána, Chester Beatty Library and Assay Office who currently have parking access retire; if he intends to remove parking access from current officials to ensure the longevity of the site, in view of the castle's historic importance; if he intends to do so, the date of same; when the last new car parking permit or access was given out for the lower yard of the castle and for what period of time; the criteria there is at present or will be in the future for the exceptional basis for parking; and if he will make a statement on the matter. Car parking in the lower yard of Dublin Castle in being reduced incrementally in a number of ways. The lower yard is now free of cars at weekends and on bank holidays. Cars are no longer permitted to park in front of the Stamping Building and in the area near the Chapel Royal. These measures have been introduced in the last 6 months or so. Car parking within the Dublin Castle campus generally is by permit only. It is intended to reduce the overall numbers of permits over time in consultation with all relevant stakeholders. The retirement of officials has no bearing on the extent of permits allocated by the Office of Public Works to the Departments and Agencies occupying accommodation at Dublin Castle. Permits are generally allocated in a block to these Departments or Agencies and it is a matter for them to allocate individual permits. The Office of Public Works has no information as to when a Department or Agency last issued a permit to park in Dublin Castle. No specific permits are issued for the lower Castle yard. The type of exceptional event contemplated for the future would be, for example, State visits or other similar important events.

The Office of Public Works has no responsibility for the maintenance of the channel at this location. The investigation of the flooding is a matter for Kerry County Council in the first instance.

It is open to the Council apply for funding under the Minor Flood Mitigation Works Scheme. Any application received will be assessed under the eligibility criteria, which include a requirement that any measures are cost beneficial, and having regard to the overall availability of funding.

Public Procurement Contracts Tenders

The National Procurement Service (NPS) is focused on developing centralised arrangements for the procurement of goods and services used commonly across the public service nationwide. The benefits arising from these central arrangements include: cash savings; administrative savings from reduced duplication of tendering; greater purchasing expertise; improved consistency; and enhanced service levels. I have previously stated that the impact of centralised procurement on local jobs had been carefully considered and that substantial dialogue with representatives of the small and medium enterprise (SME) sector had taken place.

The greater use, where appropriate, of multi-supplier frameworks can address local supplier issues while also ensuring on-going cost competitiveness of the framework itself. Such multi-supplier frameworks can also offer SMEs the opportunity to participate in national level contracts, thereby offering valuable reference work when competing for public procurement contracts in other jurisdictions.

In order to lighten the burden placed on SMEs when tendering the NPS operates in line with the best practise recommendations of the Department of Finance Circular 10/10. These steps include the use of proportional criteria for turnover and qualification, proportional insurance levels being set, ensures that there is no requirement for companies to submit all relevant paperwork (e.g. tax clearance certificates, auditors statements) upfront. The NPS also uses the eTenders website to ensure all companies can access the documentation and any clarifications quickly and freely.

The National Procurement Service (NPS) has also developed standardised tender documentation to explicitly encourage the participation of SMEs. In these documents SMEs are actively encouraged to form consortia or similar business relationships. SMEs that believe the scope of the competitions are beyond their technical or business capacities are encouraged to explore the possibilities of forming relationships with other SMEs or with larger enterprises. Through such relationships they can participate and contribute to the successful implementation of any contracts that resulted from these competitions.

Larger enterprises are also encouraged to consider the practical ways that SMEs could be included in their proposals to maximise the social and economic benefits of the contracts that result from these tenders. For example Codex Ltd, the indigenous company which won the Stationery contract, is sourcing up to 60% of their products using 136 local agents and manufacturers.

In order to encourage greater SME participation the NPS, over the past three years, has conducted a targeted programme of education for suppliers who wish to learn more about doing business with the Irish Public Service. This programme consists of seminars, workshops and large scale 'meet the buyer' events hosted nationwide. To date the NPS has facilitated workshops and presented at seminars to over 4,500 SMEs nationwide. Parallel with these events the NPS also works closely with business representative bodies such as ISME and IBEC to provide briefings for their members.

Whilst the government want better value for money for its substantial procurement spend they are also very anxious to see the SME sector actively participating in this public sector procurement program.

The Labour Relations Commission (LRC) is an independent statutory body under the aegis of my Department. As an independent quasi-judicial body, I have no role in the day-to-day exercise of its functions.

I am informed that the total cost of providing interpreters for the Labour Relations Commission, per year, from 2007 to 2012 was as set out in the table below.

Since coming to Office I have made 71 appointments to the State Boards under my aegis. It should be noted that of these, only 24 of these were new appointments made at my discretion. 9 were reappointments, and the remaining 38 were allocated under legislation to Department Representatives, social partners, nominees of other Ministers, nominees of prescribed bodies and appointments on an Ex Officio basis and were not appropriate, therefore, for public advertisement.

Of the 24 new appointments made at my discretion, I have made 15 appointments to State Boards arising directly from applications from the public.

A vacancy in respect of a Ministerial Appointment arose on the board in early 2012. An advertisement was posted on the Public Appointments Service website for filling of the vacant post. In response to the advertisement, a total of six expressions of interest were received. The applications were assessed by staff from the Department and the Public Appointment Service and the shortlisting for Ministerial appointment were agreed. Arising from this shortlist, Ms Muireann O’Neill was the Ministerial nominee.

Following the Government decision to merge Shannon Development with Shannon Airport it was agreed that there would be commonality in filling the vacancies of both boards until such time as the new entity is in place. It was intended that such appointments would maximise synergies between the two entities until such time as the merger is confirmed. Hence these appointments were made on the basis of the expertise and knowledge of the nominees. There is currently one vacancy on the Shannon Development Board.

*Section 9.3 of the 2003 Industrial Development (Science Foundation Ireland) Act 2003 determines that each year (on anniversary of formal establishment of SFI – 25th July 2003) that the two longest serving members of the Board shall retire from the Board with effect from July 24th each year. However, there is also a stipulation in the legislation that a member cannot serve more than ten years in succession.

In 2012, one vacancy was filled after a Public Appointments Service advertisement following which 19 applications were received. At present there are no vacancies on the SFI Board athough three vacancies will arise in late July 2013. These are currently on the Public Appointments Service website.
