Deputy Mary Lou McDonald asked the Minister for Public Expenditure and Reform if he will recall his circular of July 2012; and if he will issue a new circular to all public service procurers informing them that the use of the framework agreements is simply optional and not mandatory. 49. Deputy Mary Lou McDonald asked the Minister for Public Expenditure and Reform the action he intends to take following the recent High Court judgment which concluded that his Department's Circular 06/12 is ultra vires and incompatible with EU law as it makes the use of the Managed Print Services Framework Agreements mandatory. I propose to take Questions Nos. 44 and 49 together.

As both of these questions relate to the Department for Public Expenditure and Reform Circular 06/12 I propose answering them together.

At the end of May the High Court gave its judgment on certain preliminary issues in relation to the case to which the Deputy refers. The matter was then back before the court in early June for further consideration and, on foot of a request made by the applicants, was adjourned for a number of weeks.

Upon receipt of the final High Court Order on this matter, the Minister and Department will review the judgement and take any necessary actions.
