276. Deputy Arthur Spring asked the Minister for Education and Skills if an application for special educational needs supports has been processed by the National Council for Special Education in respect of a school (details supplied) in County Kerry and if the school will be allocated more support; and if he will make a statement on the matter. I wish to advise the Deputy that the National Council for Special Education (NCSE), through its network of local Special Educational Needs Organisers (SENOs), is responsible for processing applications from schools for special educational needs supports, including the allocation of resource teachers and Special Needs Assistants (SNAs) to schools. The NCSE operates within my Department's established criteria for the allocation of Special Education supports and the staffing resources available to my Department. All schools were advised to apply to the NCSE for resource teaching and SNA support for the 2013/14 school year by 15th March, 2013. The NCSE has now published details of all of their allocations for resource teaching and SNA support for the 2013/2014 school year. These details are now available on the NCSE website, www.ncse.ie, and detail the allocations made for each school on a per county basis. In order to meet any late demand for resource teaching support which may have arisen between 15th March, 2013 and the start of the school year, the NCSE requested all schools to submit outstanding applications for resource teaching support to the NCSE by 20th September, 2013. Applications for resource teaching support received to this point will be considered by the NCSE. In relation to SNA support, schools should contact the NCSE if they have enrolled children who were not considered at the time that the SNA allocations were made to schools, or where they are seeking a revision to the quantum of SNA support which has been allocated to them for the coming school year. In general, a revision to SNA allocations will only be made in circumstances where schools have enrolled new pupils, or where schools can demonstrate that they do not have sufficient SNA posts to cater for the care needs of all of the qualifying children in their school. All schools have the names and contact details of their local SENO. Parents may also contact their local SENO directly to discuss their child's special educational needs, using the contact details available on www.ncse.ie.

Officials in my Department have confirmed with Student Universal Support Ireland that in the case of the student referred to by the Deputy, following an appeal to the SUSI Appeals Officer the original decision of the awarding authority was upheld and a decision letter issued on 12th July 2013. Where an appeal is turned down in writing by SUSI and the applicant remains of the view that the scheme has not been interpreted correctly in his or her case, an appeal form outlining the position may be submitted by the applicant to the independent Student Grants Appeals Board. The relevant appeal form will be available on request from SUSI.

Officials in my Department have been advised by Kerry Education and Training Board (Kerry ETB), the awarding authority in this case, that the student referred to by the Deputy was awarded 100% of the standard Non-Adjacent Rate of grant. If an individual applicant considers that she/he has been unjustly refused a student grant, or that the rate of grant awarded is not the correct one, she/he may appeal, in the first instance, to the awarding authority in this case Kerry ETB. Where an individual applicant has had an appeal turned down, in writing, by the awarding authority, and remains of the view that they have not interpreted the scheme correctly in his/her case, an appeal form outlining the position may be submitted by the applicant to the Minister.

European University Institute

The European University Institute (EUI) is a postgraduate research institution established by the Member States of the European Union. The convention establishing the EUI was signed in April, 1972 and Ireland acceded to the convention in March 1975. The EUI's functions include advanced post-graduate and post-doctoral teaching, and research across four Departments - History and Civilisation, Economics, Law and Political and Social Sciences. Article 5 of the Convention sets out the authorities of the Institute, being the High Council, the Principal of the Institute and the Academic Council. Article 6 outlines the composition and responsibilities of the High Council, which involves the main guidance of the Institute, directing its activities and supervising its development. This includes, for example, the appointment of the Principal and the Secretary of the Institute, the approval of the Institute's budget and giving a discharge to the Principal in respect of the implementation of the budget, the approval of the general teaching policy, the creation of posts for professors assigned to the Institute and the creation of interdisciplinary centres within the Institute. Article 6 also provides that the High Council be composed of representatives of the Governments of the Contracting States and that the office of President of the High Council shall be held for one year by a representative of each of the Contracting States in turn. Ireland holds the office of President of the High Council from March 2013 to March 2014. The President works closely with the Principal of the Institute, its Secretariat and the other Contracting States represented on the High Council in directing the activities of the Institute, supervising its development and discharging the responsibilities of the High Council set out in the Convention.

The new phase of Multirank was launched by the Commission in Dublin at a major higher education conference on Increasing the Visibility of Quality in Higher Education, held at the end of January. Implementation of this new phase is succeeding very well and it has been confirmed that almost 700 universities and colleges have now registered their interest from right across the EU and from a total of over 70 countries worldwide. I understand that this includes a diverse range of Irish higher education institutions, including both universities and institutes of technology, are represented. As this phase is still under development, a final list of named participants will not be confirmed until the ranking is published. U-Multirank is on the right track to provide a better guide – for governments, institutional leaders, students and employers – to the performance of our higher education institutions and those involved are making enormous efforts to avoid the pitfalls in terms of methodology and biases that are the hallmark of many other ranking systems. I am looking forward to seeing it grow and develop over the years.

I wish to advise the Deputy that the level of resources being devoted to supporting children with Special Educational Needs has been maintained at €1.3 billion this year. This includes provision for 10,575 Special Needs Assistants (SNAs) and nearly 10,000 Learning Support and Resource Teachers. These resources have been protected despite the ongoing severe financial position and a requirement to make expenditure savings across a range of areas. There has been no reduction to the number of SNA posts being provided for schools for the coming school year. This provision remains at 10,575 posts, which will ensure that all children who qualify for access to SNA support for the coming school year will receive access to such support. In relation to the allocation of resource teaching support for schools, the Deputy will be aware that in June of this year I authorised the NCSE to maintain the level of resource teaching allocations to be provided for students with special educational needs for the current school year to the 2012/13 levels. There will therefore not be a reduction in resource teaching time for these pupils over the amount of support provided last year. Details of the SNA and resource teaching allocations which have been made to schools by the NCSE to date for the 2013/2014 school year are now available on the NCSE website www.ncse.ie, which provides details of the SNA and resource teaching allocations for each school on a school by school and per county basis.

The Deputy will also be aware that the NCSE recently published comprehensive policy advice on Supporting Students with Special Educational Needs in Schools. I have, as suggested by the Report, requested the NCSE to establish a Working Group to develop a proposal, for consideration, for a new allocation model for teaching supports for children with Special Educational Needs based on the profiled educational needs of children in schools, and which will aim to ensure that resources are directed to those children and schools who need them most.

I propose to take Questions Nos. 282 and 318 together. Officials in my Department have confirmed with Student Universal Support Ireland (SUSI) that the student referred to by the Deputy made an application for the 2013/14 academic year on 31st July, 2013. A document checklist issued to the applicant on 20th August 2013. The requested documentation was recently returned and will be reviewed shortly. SUSI will contact the student directly in relation to the outcome. If an individual applicant considers that she/he has been unjustly refused a student grant, or that the rate of grant awarded is not the correct one, she/he may appeal, in the first instance, to SUSI. Where an individual applicant has had an appeal turned down, in writing, by SUSI, and remains of the view that SUSI has not interpreted the scheme correctly in his/her case, an appeal form outlining the position may be submitted by the applicant to the Student Grant Appeals Board. The relevant appeal form will be available on request from SUSI.

The State Examinations Commission has statutory responsibility for operational matters relating to the certificate examinations including organising the holding of examinations, determining procedures in places where examinations are conducted including the supervision of examinations and making arrangements for the marking of work presented for examination. As the Deputy will be aware, I recently published a draft General Scheme for an Education (Admission to Schools) Bill, 2013 as well as draft regulations for discussion ahead of enacting legislation. I have referred the draft General Scheme and draft regulations to the Oireachtas Joint Committee on Education and Social Protection, to allow a full public discussion of the proposed legislative framework, including inputs from parents and the education partners. I hope the Committee will give this early consideration so that we can proceed to the next stage of legislation as soon as possible. In bringing forward these proposals, my policy objective is to ensure that every child is treated fairly and that the way in which schools decide on applications is structured, fair and transparent. As the Bill and the Regulations will be published in draft form, they will also be subject to a lot of detailed scrutiny before becoming law. I will be reflecting carefully on the views expressed in the consultation process to ensure they strike the right balance between school autonomy and fairness in our education system.

The Deputy will be aware that the National Council for Special Education (NCSE), through its network of local Special Educational Needs Organisers (SENOs), is responsible for processing applications from primary and post primary schools for special educational needs supports, including the establishment of special classes. SENOS are a valuable source of support to parents who are actively sourcing a placement for their children. SENO contact details are available on www.ncse.ie. The NCSE operates within my Department's criteria in allocating such support. I have therefore arranged for the Deputy's question to be forwarded to the NCSE for their attention and direct reply. I wish to advise that that 20 hours per week home tuition has been approved for the children to whom the Deputy refers. The tuition will be provided as an interim measure pending the identification of a school placement.

I propose to take Questions Nos. 290 and 286 together. The core function of the redeployment arrangements is to facilitate the redeployment of all surplus permanent teachers to other schools that have vacancies. The redeployment of all surplus permanent teachers is key to the Department's ability to manage within its payroll budget and ceiling on teacher numbers. Thereafter, schools are required under the panel arrangements to fill permanent vacancies from supplementary panels comprised of eligible fixed-term (temporary/substitute) and part-time teachers. The detailed arrangements for panel access for fixed term (temporary), substitute and part-time teachers for the 2013/14 school year are set out in Circular 0038/2012 which is available on the Department website. All eligible applicants who met the eligibility criteria were placed on the relevant supplementary panels. Applicants who did not meet the eligibility criteria were informed accordingly by my Department earlier this year. There is no mechanism to expand the criteria to cater for unsuccesful applicants.

Under the terms of the student grant scheme, grant assistance is awarded to students who meet the prescribed conditions of funding including those which relate to nationality, residency, approved course, previous academic attainment and means. Students commencing a new course in the academic year 2013/14 are required to submit their grant application to Student Universal Support Ireland (SUSI) via www.susi.ie. to have their eligibility for grant assistance assessed. Students attending approved postgraduate courses in Northern Ireland may be eligible for assistance towards their postgraduate fees up to the maximum fees limit of €6,270 or a Postgraduate Fee Contribution of €2,000 subject to satisfying the terms and conditions of the Student Grant Scheme 2013. Officials in the Department of Employment and Learning in Northern Ireland have confirmed that a student from another European Union (EU) country studying in Northern Ireland can apply for a student loan to cover the cost of tuition fees. Further information is available on www.nidirect.gov.uk. In addition, tax relief at the standard rate of tax may be claimed in respect of tuition fees paid for approved courses at approved colleges of higher education including approved undergraduate and postgraduate courses in EU Member States and in non-EU countries. Further information on this tax relief is available from the Revenue Commissioners on www.revenue.ie.

Durkan asked the Minister for Education and Skills the extent to which his Department has developed a strategy to modernise the State education system to reflect a curriculum based on ethical education; if his Department's attention has been drawn to the educational benefits of the Educate Together programme; and if he will make a statement on the matter. Religious education is one of the seven curricular areas of the Primary Curriculum and schools are currently required to allocate thirty minutes per day for religious instruction. However, unlike other subject areas, the content of the religious curriculum provided by schools is not set by my Department. The Education Act recognises the rights of the different church authorities to design curricula in religious education and to supervise their teaching and implementation. This means that the content of the religious education programme in a particular primary school is determined by the patron of the school. The situation is similar at post primary level, where a programme of religious instruction approved by the school patron may be offered. However, post primary schools also have the option of using the Religious Education curriculum which has been designed as an examinable subject at Junior and Leaving Certificate by the National Council for Curriculum and Assessment (NCCA). The NCCA syllabuses are academic in nature. They are concerned with understanding religion as a phenomenon in the world and are designed to be studied by students of all religious faiths and of none. The new specification for Religion in Junior Cycle, as part of the new Junior Cycle Framework, will be available for September 2017. It is important to note that, under section 30 of the Education Act (1998), no student can be required to attend instruction in any subject which is contrary to the conscience of the parent of the student. My Department continues to implement the measures identified in the Action Plan that I published in June 2012 in response to the Report of the Advisory Group to the Forum on Patronage and Pluralism. As well as implementing the measures that will ensure that school patronage, in the selected areas, reflects parental preferences, I have also requested the NCCA to start exploring, with the education partners and religious interests, the development of Education about Religion and Beliefs (ERB) and Ethics programmes which will supplement existing faith formation programmes in schools. The developmental work will draw on current practice in schools in this area as well as international good practice and research and will be informed by the same pedagogical principles that underpin the rest of the primary school curriculum. The work will also be informed by the experiences of the Community National Schools, under the auspices of the Education and Training Boards. The unique 'Goodness Me Goodness You' multi-belief programme being developed with and by those schools in an action research approach, is premised on inter-religious dialogue and dialogue between religion and belief systems. The programme they are developing will become available on-line over the coming months and it will be of interest to all working in the field of religious education.

I propose to take Questions Nos. 291, 304, 305 and 383 together. In September 2012 Athlone Institute of Technology (AIT) commenced a BSc in Audiology course despite a request from the HEA in August 2012 that it be cancelled. The course was included in the CAO handbook by AIT without prior agreement from the HSE in relation to the provision of clinical placements. The HEA's concern was that the students on the programme would be proceeding on a course without an agreement in place in relation to the provision of clinical placements, and as a consequence would undertake an incomplete course of study. In November 2012, out of concern for the position of students involved, the HSE agreed that it would support the students who had already commenced the course to access clinical placements provided AIT succeeded in achieving accreditation for the course. Institutes of Technology are autonomous statutory bodies with responsibility for their own academic affairs and it is the responsibility of the institutions themselves to secure accreditation and professional recognition for particular courses where appropriate. It is normal practice with new courses leading to a professional accreditation that they must operate for a period while accreditation is being established. In the case of the AIT course, the Institute initially sought accreditation from the British Academy for Audiology (BAA). However, AIT encountered difficulties in obtaining this accreditation and the BAA subsequently suspended their accreditation process. A number of alternative options for accrediting the course were examined. However, the institute was unable to get the required accreditation and the HEA was advised in May 2013 of AIT's decision to discontinue the programme. On foot of a High Court Judicial Review in August 2013 the HSE agreed to offer twelve clinical placements for the students and to work with AIT to secure other placements on the understanding that a Professor Audiology would within six months write and endorse the course as being equivalent to a BSc in Audiology internationally. Based on the above understandings, the HEA has agreed to fund the programme for this cohort of students. This agreement by the HSE and HEA allows AIT to recommence the audiology programme thus enabling the students to continue with their course. The total legal costs of the action for AIT are not yet available, however I understand that the institute has agreed that it will cover the legal fees for the students involved in the case. The HEA has kept my Department fully informed of all developments in relation to this programme and I have received regular updates on the efforts that have been taken by the HEA in consultation with the HSE to ensure that the issues with the programme are resolved in the best interests of the students.

The HEA has recently written to the President of AIT seeking clarification on a number of issues including the likely timelines associated with the appointment of an external independent Professor of Audiology and confirmation that the students have been fully informed of the risks attaching to proceeding with the course, particularly in relation to professional accreditation. In addition, at the request of the HEA, the Governing Body has initiated a comprehensive review of circumstances surrounding the matter. On finalisation of this review consideration will be given as to what further action is appropriate.

My Department provides specific teaching resources and additional grant aid to schools that offer the transition year programme. Schools in the Free Education Scheme qualify for payment of a transition year grant of €95 for each pupil participating in the programme. The cost of transition year grants in 2012 was €2.7m. My Department allocated circa 1,700 whole time equivalent teaching posts in the 2012/13 school year in respect of transition year with an estimated cost of €109m. The table attached contains the list of schools in the Free Education Scheme which offered the transition year programme in the 2011/12 school year.

293. Deputy Jonathan O'Brien asked the Minister for Education and Skills the number of primary school teachers who participated in summer training schemes in 2011/12; the amount of days in lieu awarded to PS teachers who partook in these summer schools and the amount spent by the DES in providing temporary cover for those teachers who had received time in lieu. Under Rule 58 of the Rules for National Schools, teachers are entitled to Extra Personal Vacation (EPV) days on attendance of summer courses which are approved by my Department. On completing such a course a teacher receives a Certificate of Completion which they can submit to their Board of Management and arrange to avail of their EPV days with their Board during the following year. When a teacher takes an EPV day the School Principal makes a return to my Department on the On-Line Claim System (OLCS) indicating that the teacher has availed of an EPV day. In 2011/12 a total of 27,697 primary school teachers participated in approved summer courses. The number of EPV days recorded on the OLCS for the 2012/13 school year was 53,830. There are no substitution costs incurred by the Department in the provision of EPV days.

My Department and the Department of Education, Northern Ireland take forward co-operation and joint action in education by co-ordinating and developing, within the North South Ministerial Council framework, common policies in the four designated areas of co-operation: special education needs, educational underachievement, teacher mobility and school, youth and teacher exchanges. The subject of standardisation of minimum school entry age in both jurisdictions has not come up for dicsussion in this context.

As the Deputy will be aware, I recently published a draft General Scheme for an Education (Admission to Schools) Bill, 2013 as well as draft regulations for discussion ahead of enacting legislation. I have referred the draft General Scheme and draft regulations to the Oireachtas Joint Committee on Education and Social Protection, to allow a full public discussion of the proposed legislative framework, including inputs from parents and the education partners. I hope the Committee will give this early consideration so that we can proceed to the next stage of legislation as soon as possible. In bringing forward these proposals, my policy objective is to ensure that every child is treated fairly and that the way in which schools decide on applications is structured, fair and transparent. As the Bill and the Regulations are published in draft form, they will also be subject to a lot of detailed scrutiny before becoming law. I will be reflecting carefully on the views expressed in the consultation process to ensure they strike the right balance between school autonomy and fairness in our education system.

My Department has provided funding to a number of groups, including Right of Place, to provide an information and referral service, since 2001. Up to the end of 2012, the overall cost in relation to this organisation is €1.198m, which includes the cost of the associated co-ordinator. The funding is channelled through the City of Cork VEC and expenditure of these funds has been monitored by a co-ordinator engaged by the VEC on behalf of the Department until May 2013. My Department continues to monitor the expenditure of this organisation and receipts are provided along with the annual accounts of the organisation. In addition to my Department's funding, this organisation also receives funding from the Health Service Executive. As advocated by the Comptroller and Auditor General in his Special Report No. 74 of September 2010, my Department liaises with the HSE to ensure a coordinated approach to its funding and that no duplication of funding arises. In the wider context, I previously announced that as responsibility for information for survivors will be taken on by the Statutory Fund, funding of Survivor Groups by my Department will cease. As a consequence, all Survivor Group funding will cease with effect from 31st December 2013.
