Deputy Kevin Humphreys asked the Minister for Education and Skills if he will provide a list of all bodies, boards or committees under the remit of his Department to which ministerial appointments are made; the statutory provision providing for the making of such appointments in each case; the annual allowances or other payments made to the chairperson; the annual allowance or other payment made to an ordinary member; and if he will make a statement on the matter. The day to day management of agencies, including the payment of travel and subsistence expenses in accordance with Department of Public Expenditure and Reform guidelines, is a matter for the management of each agency and is generally available in the annual reports and accounts of agencies.Additional information is available from the websites of the bodies in question, and information on an annual basis is generally collated in their annual reports which are available on their websites.

I propose to take Questions Nos. 308 and 309 together.

I understand from Student Universal Support Ireland that the student referred to by the Deputy has been contacted by phone and a letter informing the student of the outcome of his appeal is being issued.

For the Deputy's information, attached is a list of the agencies under the aegis of my Department.

There are currently no vacancies. With the planned establishment of Seirbhísí Oideachais Leanúnaigh agus Scileanna (SOLAS) in the autumn, the incoming chairperson and board of SOLAS are currently the subject of the appointments process. It is anticipated that these positions will be filled in the coming weeks.

Student Grant Scheme Eligibility

Deputy Colm Keaveney asked the Minister for Education and Skills if he will confirm that students will be entitled to a third level grant from Student Universal Support Ireland if, satisfying all other criteria, they are going from an appropriate degree with an NFQ level of 8 to a professional diploma in education which has an NFQ level of 8; that condition of progression will be waived in this case, in view of the fact that the professional diploma is a necessary qualification to work as a teacher; and if he will make a statement on the matter. The Professional Diploma in Education (PDE), previously known as a Postgraduate Diploma in Education (PGDE), was placed on the framework of qualifications at Level 8 with effect from the start of the academic year 2011/12. The course is considered to be a postgraduate course for the purposes of the Student Grant Scheme.

To satisfy the terms and conditions of the student grant scheme in relation to progression, a student must be moving from year to year within a course, having successfully completed the previous year or be transferring from one course to another, where the award for the subsequent course is of a higher level than the previous course.

The objective of this policy is to help as many students as possible to obtain one qualification at each level of study. Given the level of demand on the student grant budget from first time students and students that are progressing with their studies to a higher level, there are no plans at present to change the arrangements in place.

For the purposes of the student grant scheme a student who has successfully completed an undergraduate course at Level 8 and is transferring to a postgraduate course at Level 8 of the framework of qualifications or equivalent is deemed to be progressing.

The Deputy will appreciate that in the absence of all of the relevant details that would be contained in an individual's application form, including relating to residency, nationality, academic attainment and means it would not be possible for me to say whether or not a student would qualify for a grant.

Students commencing a new course in the academic year 2013/14 are required to submit their grant application to Student Universal Support Ireland (SUSI) via www.susi.ie. to have their eligibility for grant assistance assessed.

Tax relief at the standard rate of tax may be claimed in respect of tuition fees paid for approved courses at approved colleges of higher education including approved undergraduate and postgraduate courses. Further information on this tax relief is available from the Revenue Commissioners.

Student Grant Scheme Eligibility

Those who meet the qualifying conditions for the special rate of grant under the Student Grant Scheme will be eligible to have their post-graduate tuition fees paid up to the maximum fee limit of €6,270. Currently maintenance support is not available for students entering postgraduate courses.

To qualify for the special rate of grant an applicant must meet the following conditions: 1. Reckonable income must not exceed €22,703. 2. On the 31st December of the relevant period the reckonable income must include an eligible long-term social welfare payment prescribed under the scheme.

A postgraduate student may qualify to have a €2,000 contribution made towards the costs of their fees. The income threshold for this payment is €31,500 for the 2013/14 academic year, increasing relative to the number of family dependents.

Tax relief is also available on postgraduate tuition fees. Details in relation to this relief are available from the Revenue Commissioners.

In addition to this, the Student Assistance Fund will continue to be made available through the access offices of third-level institutions to assist students in exceptional financial need.

The assessment of means under my Department's student grant scheme is based on gross income from all sources. Therefore, all income is assessed from the same starting point, eliminating any distortion which might arise from different spending decisions.

The means test arrangements of the student grant scheme are applied nationally. In the case of both employed and self-employed applicants, gross income is assessed with certain specified social welfare and health service executive payments excluded.

The eligibility of an applicant, or the level of the grant awarded, may be re-assessed by SUSI in the event of a change of circumstances in the academic year. The applicant should in the first instance contact the relevant awarding body and notify them of the change in circumstances.

I have no plans at present to depart from the above practice in respect of the determination of income.

In addition, the Student Assistance Fund will continue to be made available through the access offices of third-level institutions to assist students in exceptional financial need. The access offices themselves also provide support and advice to students to enable them to continue with their studies.

Schools Building Projects Status

Responsibility for the delivery of a new 16 classroom school referred to by the Deputy has been devolved to the Office of Public Works.

The project is at the early stages of architectural planning and I understand that the OPW is currently liasing with the school authorities to progress the sketch scheme for the school. A site survey has been completed and a building survey on the existing historical building is being planned. An Ecological Screening Report required prior to planning has commenced and is due to be completed next week.

The school project is included in the 5 Year Construction Programme announced in March 2012 and is scheduled to commence construction in 2014/2015. Final decisions as to when construction will commence will be dependant on the progress of the project through the various stages of design and the local authority planning process.

School Holidays

The scheduling of the school holiday periods during the academic year is agreed between the managerial authorities of schools, the teacher unions, the Department of Education and Skills and the Department of Public Expenditure and Reform under the auspices of the Teachers Conciliation Council.

The current agreement covers the school years 2011/12 to 2013/14. Discussions in regard to the arrangements for the school years 2014/15 to 2016/17 will take place during the current school year.

The arrangements in relation to the standardised school year do not require that the start or end of the school year should be standardised. However, schools must provide of a minimum of 167 teaching days at post-primary level and 183 teaching days at primary level.

Student Grant Scheme Appeals

For student grants purposes, students are categorised according to their circumstances either as students dependent on parents or a legal guardian, or as independent mature students. An independent mature student is defined as a mature student who was not ordinarily resident with his or her parents or legal guardian from the October preceding entry or re-entry to further or higher education.

Where an individual applicant has had an appeal turned down, in writing, by SUSI, and remains of the view that SUSI has not interpreted the scheme correctly in his/her case, an appeal form outlining the position may be submitted by the applicant to the Student Grant Appeals Board. The relevant appeal form will be available on request from SUSI.

I understand from Student Universal Support Ireland (SUSI) that the SUSI website provides general guidance to students of different classes who may be considering applying for a grant and also provides specific information where it is relevant to the majority of grant applicants in any class. All applicants are advised to refer to the relevant terms of the student grants scheme and to other sources of official guidance and information about the scheme before considering whether they should apply for a grant.

The Student Grant Scheme 2013 (Part 2, Section 8(2)) provides that fee grants are not payable in respect of PLC (post leaving certificate) courses. Maintenance grants are however payable in respect of such courses and the amount paid varies according to income and other criteria but is subject to a maximum income limit as the Deputy has highlighted. Thus PLC course participants whose income exceeds this limit are not eligible for any grant assistance while higher education course participants may continue to be eligible for fee grants at income levels above this limit.

The table of information provided by SUSI attached in regard to income limits is designed to apply to the maximum number of cases. However the information has been amended to reflect the distinction highlighted by the Deputy as it applies to a particular group of applicants and I am grateful to the Deputy for bringing this matter to attention.
