Question:

100. Deputy Shane Ross asked the Minister for Education and Skills the number of quangos operating under the aegis of his Department; the total number of directors sitting on their boards; the aggregate fees incurred by the State in paying the remuneration of directors of these quangos; the number of quangos that have been created since the formation of the Government; the number that have been disbanded over the period; the projected cost to the taxpayer of the establishment and operation of these new quangos; and if he will make a statement on the matter. The information requested by the Deputy in relation to non-commercial State bodies under the aegis of the Department of Education and Skills can be downloaded from my Department's website. http://www.education.ie/en/The-Department/Agencies/Details-of-Membership-of-State-Boards/ For the Deputy's information under the Public Service Reform plan the following were identified for rationalisation or merger and since March 2011 the following actions have taken place.The Irish Research Council for Science, Engineering and Technology and Irish Research Council for Humanities and Social Sciences were merged in March 2012 to form the Irish Research Council (IRC). The IRC has been established as a sub-board of the Higher Education Authority (HEA). There was a saving of €100,000 in 2012 and 2013. Under the provisions of the Qualifications and Quality Assurance (Education and Training) Act 2012, the National Qualifications Authority of Ireland (NQAI), the Higher Education Training Awards Council (HETAC) and the Further Education Training Awards Council (FETAC) were amalgamated to form a new agency, the Quality and Qualifications Ireland (QQI). Estimated likely saving on an annual basis will be €1 million by 2014. Under the provisions of the Education and Training Boards Act 2013 the Vocational Education Committee (VEC) system was reconfigured, with the number of further education bodies being reduced from 33 to 16. Full year savings are estimated at €2.1m. Further savings are likely to be achieved through realisation of economies of scale arising from the mergers and the wider Education and Training Sector Reform Programme. Under the provisions of the Further Education and Training Act 2013 FÁS was dissolved in October 2013, with a new training authority, An tSeirbhís Oideachais Leanúnaigh agus Scileanna (SOLAS) being created with responsibility for funding, planning and co-ordinating training and further education programmes.

Following the enactment of the Residential Institutions Statutory Fund Act 2012, the necessary steps have been taken to dissolve the Education Finance Board in March 2013 and establish the Residential Institutions Statutory Fund Board (Cara Nua). This body will be funded from the contributions of the religious congregations offered in response to the request for additional contributions, following the publication of the Ryan Report.

Note 2: The Chairperson of the Commission to Inquire Into Child Abuse (CICA) is a member of the Judiciary and is not paid by the CICA. The ordinary members of the Commission, who were all salaried are not currently on the payroll.

Note 3: The Chairman of the RIRB is paid an annual salary equivalent to a serving President of the Circuit Court subject to abatement to take account of his pension. In relation to the RIRC, the Chairman's salary is linked to his former Supreme Court judicial salary subject to pension abatement. Since October 2011, the Chairman has taken a 50% voluntary reduction in his salary. The other board members of both the RIRB and the RIRC are paid a per diem rate and pension abatement applies in the case of members receiving a pension from the State. As I already mentioned in a previous reply, the procedures for making an application for a determination of valuation are prescribed in section 27 of the Valuation Act, 2001.

Under section 28 (4) of the Act, a Revision Officer appointed by the Commissioner may carry out a revision of valuation in relation to a particular property only if a material change of circumstances (MCC) has occurred since the property was last revised. MCC is defined in section 3 of the Act as a change of circumstances, which consist of a new building, a change in value due to structural alterations of an existing building, total or partial demolition of a building or a sub-division or amalgamation of relevant property.

Should the foregoing MCC criteria be satisfied, the appointed Revision Officer will consider the application and determine and issue a valuation for the subject property within a period of six months from the date of his appointment. If dissatisfied with the outcome of the representations, there is an extensive appeal system available which the ratepayer may avail of and to which I referred in my earlier reply.

As regards the levying of rates, I wish to reiterate the position as previously outlined, that under rating law, rates can only be collected by the rating authority on property which has been valued under the Valuation Act, 2001 and there is no mechanism to otherwise collect rates pending the determination and issue of the valuation under the Act.

While the particular arrangements for the sharing of data between two Departments is a matter for the Departments concerned, it is my understanding that such sharing is generally governed by a Memorandum of Understanding which sets out the expectations on both sides.

The question of the governance of data-sharing is of great importance. In recognition of this, the Government recently requested my Department to prepare the Heads of a Data-Sharing and Governance Bill, with the following core objectives: to make lawful data-sharing easier by providing a framework that public bodies can use to establish the necessary legal basis; to improve the governance and security of all data-sharing in the public service; and to provide a mechanism that can be used to encourage public bodies to move away from paper documents when dealing with citizens and businesses.

In response to the Deputy’s question, as part of the Public Service Reform Plan, within my own area of control, the Commission on Public Service Appointments was merged into the Office of the Ombudsman with effect from October 2012. Arrangements are also currently underway for the merger of the Valuation Office, the Property Registration Authority and Ordnance Survey Ireland; and the measure concerning the State Laboratory and the Forensic Science Laboratory is progressing. No new State Bodies or Agencies have been created in the Department of Public Expenditure and Reform since the formation of the Government.

There are currently 447 Directors within the 35 County and City Enterprise Boards. They are appointed by the Boards themselves, in line with the provisions laid down in the Articles of Association for the Boards and I have no role in the appointments. All of the Directors work in a voluntary, and unpaid, capacity.

The Competition Authority does not have a Board of Directors; it has a Chairperson and three Members.

While the payment of fees to directors of Agencies under my remit is an operational matter for the Agencies concerned, for which I have no direct function, I understand that this information is contained in the Annual Reports of the Agencies that have been published for the years concerned.

I can advise the Deputy that no new State Agencies have been created by me since 9 March 2011.

However, I would draw the Deputy’s attention to the fact that, following enactment of the Microenterprise Loan Fund Act 2012, Microfinance Ireland was established as a private limited company in August 2012, as a subsidiary of the Social Finance Foundation and has charitable status. Its Directors are working on a voluntary, pro bono basis.

Microfinance Ireland has been funded by the Government to provide loans to newly established and growing microenterprises across all industry sectors that do not meet the conventional risk criteria applied by banks.

Further, there is a substantial programme of reform underway within my Department in relation to Agencies and Offices. The Agencies under the remit of my Department that are scheduled to be rationalised, merged or abolished are set out under the Government’s Agency Rationalisation Programme. These reforms include:

- Merge the National Consumer Agency and the Competition Authority into one single entity.

- Dissolve the 35 County Enterprise Boards and transfer their functions to Enterprise Ireland. These functions will be delivered by a network of Local Enterprise Offices located in Local Authorities. This will facilitate the delivery of an enhanced service and range of supports to the micro and small business sectors.

- Dissolve Forfás and provide for the transfer of the agency’s assets, liabilities and staff to my Department and other bodies, as appropriate.

- Transfer relevant enterprise functions from Shannon Development to IDA, EI and Bord Fáilte and merge Shannon Development with Shannon Airport Authority.

- Reform of the State's Workplace Relations Services to deliver a simplified two-tiered structure comprising a single body of first instance, the Workplace Relations Commission, and a single body of appeal, in effect an enhanced Labour Court.
