108. Deputy Denis Naughten asked the Minister for Jobs, Enterprise and Innovation when a decision will be made on a work permit in respect of a person (details supplied); and if he will make a statement on the matter. [52252/13]

A Work Permit application made by an employer in respect of the person named by the Deputy was refused on 23 July 2013 on the grounds that it appeared that no Labour Market Needs Test had been carried out in support of the application. A review of this decision was sought in accordance with Section 13 the Employment Permits Act, 2006 but this request was not received within the statutory timeframe and was thus too late to be considered. I understand that a second work permit application was then submitted to my Department by the employer on 22 August 2013 which was subsequently withdrawn.

A third application was submitted by the person named by the Deputy on his own behalf on 29 October 2013. This application was refused on 13 November 2013 on the grounds that certain occupations are not deemed eligible for employment permits where it is considered that there is already a sufficient supply of labour in the labour market for the filling of such vacancies, or where the occupation requires a low level of skill and experience and therefore can be filled by the existing supply of labour or where it is not in the broader public interest to fill the vacancy. It appeared from the information received that the position on offer is one of the occupations currently ineligible for a new employment permit. In addition it appeared from the information submitted that the proposed employee's current immigration status precluded them from entering full-time employment in the State.

A request to review this decision in accordance with Section 13 of the Employment Permits Act 2006 was received on 4 December 2013 and this review will take place shortly.
