201. Deputy Brendan Griffin asked the Minister for Agriculture, Food and the Marine if a single farm payment penalty will be waived in respect of a person (details supplied) in County Kerry; and if he will make a statement on the matter. [54628/13]

Following a review of the eligibility of land declared by the person named on his 2013 Single Payment Scheme application it was identified that ineligible features were included in the areas claimed. The applicant was informed of the outcome of the review and of his right to seek a review of the decision. An application for a review was submitted and is currently under consideration by my Department. The applicant will be informed of the outcome of the review. If he is not satisfied with the outcome, he can submit an appeal to the Independent LPIS Appeals Committee.
