Carer's Allowance Appeals

108. Deputy Eric Byrne asked the Minister for Social Protection the position regarding carer's allowance in respect of a person (details supplied) in Dublin 12; and if she will make a statement on the matter. [12535/14]

I confirm that the department received an application for carer’s allowance from the person in question on 22 November 2013. The person concerned was refused carers allowance on the grounds that the care recipient is not so disabled as to require full time care and attention as prescribed in regulations. She was notified of this decision on 6 January 2014, the reasons for it and of her right of review or appeal. The person concerned appealed this decision to the Social Welfare Appeals Office and submitted further medical evidence in support of the appeal. This supplementary information has been forwarded to the Department's medical assessor for consideration. If the outcome remains unchanged a submission will be prepared and her file and papers will be forwarded to the Social Welfare Appeals Office for determination.

Jobseeker's Allowance Eligibility

The social welfare system is primarily a contingency-based system, with entitlement based on defined contingencies, such as sickness, unemployment, old age or widowhood. Primary social welfare legislation provides that only one social welfare payment is payable at any one time. While it can happen that a person may experience more than one contingency at the same time - for example, an unemployed person may become sick - a general principle applies whereby even if a person experiences more than one of the contingencies at any one time, he or she only receives one of those payments. This principle is common to social security systems across the world.

In line with these provisions where a person in receipt of jobseeker’s allowance qualifies for illness benefit their jobseeker’s allowance claim is closed. If, upon expiry of the period in receipt of illness benefit, the person is unemployed he/she may submit a new claim for jobseeker’s allowance.

Rent Supplement Scheme Data

The purpose of the rent supplement scheme is to provide short-term support to eligible people living in private rented accommodation whose means are insufficient to meet their accommodation costs and who do not have accommodation available to them from any other source. There are currently approximately 78,000 rent supplement recipients for which the Government has provided over €344 million for 2014. There are currently 2,405 rent supplement recipients in County Louth and 1,920 recipients in County Meath.

I propose to take Questions Nos. 112 to 114, inclusive, and 119 together.

Tús and Gateway were established to provide short-term, quality work opportunities for those who are long-term unemployed. A key feature of these initiatives is that all selection is undertaken by random processes conducted at local level by the Department of Social Protection. Tús and Gateway are part of a suite of interventions the Department funds and they are designed to meet the priorities established by the Government in Pathways to Work.

A customer in receipt of jobseeker's payment is required to take up reasonable offers of work or training in order to retain entitlement to that payment. The opportunities offered under Tús and Gateway fall within that condition. If a reasonable opportunity of work, a work placement or training is refused without good reason, a suspension may be applied to a customer’s social welfare payment in the first instance. Should a customer continue to refuse to take up a reasonable offer under various schemes, the Department may take steps to penalise the jobseeker by reducing the value of the jobseeker's weekly payment.

While I have no proposals to alter the operational arrangements for Tús or Gateway, the Department monitors the operation of all programmes and schemes on an ongoing basis and will alter arrangements where these are considered necessary to achieve the objectives set by the Government. Advice on the opportunities across a range of work placement, internships, self-employment, training and educational supports and options can be accessed via the Department’s offices and Intreo service and further information is available on the Department’s website – www.welfare.ie.

While 3,000 places have been allocated to Local Authorities under Gateway, to date progress on the roll-out has been slower than anticipated. The following table provides details of the allocation of Gateway places offered and filled in the four Dublin local authorities up to Friday, 7 March.

The procurement of services is essential to support the Department in providing a high quality service to the public in a cost effective and efficient manner and is governed by a comprehensive regulatory, legal and procedural framework.

The Department engages a range of consultants (individuals or organisations) to provide intellectual or knowledge based services (expert analysis and advice) including the delivery of reports, studies, assessments, recommendations and proposals that contribute to decision making or policy making.

The Department is engaged in a number of service delivery modernisation and transformation programmes involving business, organisational and technological, change. In additional the Department is engaged in a number of cross cutting public service reform programmes such as the public services card. These programmes are supported by the procurement of external development services (external service provision) as well as engagement of external consultants to provide strategic technical advice.

In accordance with Department of Public Expenditure and Reform procedures, procurements of goods and services in excess of €25,000 excluding VAT and all IT procurements in excess of €10,000 excluding VAT are advertised on E-tenders.

117. Deputy Finian McGrath asked the Minister for Social Protection the position regarding a carer's allowance and a jobseeker's allowance in respect of a person (details supplied). [12603/14]

I confirm that the Department received applications from the person concerned for Carer’s Allowance on 12 April 2013 and for Jobseeker's Allowance on 14 February 2014.

His application for Carer’s Allowance was withdrawn on 1 October 2013 on the grounds that requested information was not provided to a social welfare investigator regarding his employment record while living abroad and details regarding a company he owns, in order to establish his correct entitlements. To date this information has not been furnished, and no request for a review of his claim for Carer's Allowance has been received.

His application for Jobseeker’s Allowance was refused on 3 March 2014 on the grounds that the person concerned did not meet the conditions of being habitually resident in the State. He was notified of this decision and of his right to seek a review or to appeal the decision to the independent Social Welfare Appeals Office. To date, no request for a review or appeal of this decision has been received.
