Deputy Clare Daly asked the Minister for Defence the protocol in relation to assistant principals and principal officers using their private cars and claiming unvouched expenses when official cars are available in his Department; if he has received any complaints regarding same; and the oversight that is in place to deal with same. There are no official cars available to civil servants of my Department. Where travel is deemed necessary for business purposes, staff of my Department are required to use public transport wherever possible, in accordance with Department of Public Expenditure and Reform guidelines. Where staff are authorised to use their private cars for travel on official business, mileage expenses are reimbursed at the appropriate rate set by the Department of Public Expenditure and Reform.

I can confirm that an application was received in my Department on 15 May 2013 to transfer entitlements from another farmer to the person named. Unfortunately the transfer could not be processed in my Department and I regret that under the Data Protection Act I am not at liberty to disclose the reason for the non-processing of the application. The person named may wish to make contact with the transferor with a view to clarifying the situation.

A review of the land parcels declared by the person named under the 2013 Single Payment Scheme revealed that two of the land parcels declared by the person named contained ineligible features. The person named was notified of the position in a letter dated 17 October 2013.

To date, no appeal has been received.

Single Payment Scheme Applications

Kitt asked the Minister for Agriculture, Food and the Marine if he will provide details of the penalty that prevented payment of a single farm payment in December 2013 in respect of a person (details supplied) in County Galway; and if he will make a statement on the matter. The 2012 Single Payment application of the person named was selected for Satellite Inspection, following which an over-claim of greater than 50% was confirmed. Consequently, as per the Terms and Conditions of the Scheme, no payment was made in respect of the 2012 Scheme year. In addition, an administrative fine amounting to the value of the Single Payment on the number of hectares over-declared was offset against any EU payment due to the applicant during the course of the three calendar years following the year in which the determination was made.

A letter issued to the person named on 19 December 2012 informing him of the inspection result and of his right of appeal. The administrative fine was deducted from the second instalment of the 2013 Single Payment of the person named in December 2013.
