96. Deputy Jack Wall asked the Minister for Social Protection the position regarding a supplementary welfare allowance appeal and a disability allowance appeal in respect of a person (details supplied) in County Kildare; and if she will make a statement on the matter. [17180/14]

The Social Welfare Appeals Office has advised me that appeals for Supplementary Welfare Allowance and for Disability Allowance by the person concerned were registered in that office on 5 February 2014 and 13 March 2013 respectively. It is a statutory requirement of the appeals process that the relevant papers and comments by or on behalf of the Deciding Officers on the grounds of the appeals be sought from the Department of Social Protection.

These papers were received in the Social Welfare Appeals Office with respect to the Supplementary Welfare Allowance appeal of the person concerned on 6 March 2013 and the case will be referred to an Appeals Officer who will make a summary decision on the appeal based on documentary evidence presented or, if required, hold an oral hearing.

When the papers relating to the Disability Allowance appeal of the person concerned are received from the Department, that appeal will also be referred to an Appeals Officer for consideration.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions in relation to social welfare entitlements.
