Question:

67. Deputy Charlie McConalogue asked the Minister for Education and Skills the number of students who have been unable to access a school place in a primary school for September 2014 in the Donnybrook, Sandymount, Ballsbridge and Ringsend areas; the measures he has taken to address the level of excess demand; if he will give an assurance that all students will have access to a school place in their own locality in time for September 2014; and if he will make a statement on the matter. My Department, in conjunction with some Patron bodies have taken a number of measures to ensure that additional junior infant places are available in September 2014. This includes the establishment of a new primary school, Shellybanks Educate Together N.S. in Ballsbridge which will enrol three junior infant classes. In addition, some existing primary schools have agreed to increase the level of junior infant intake in September. I understand that schools are currently liaising with parents whose children are on their waiting lists in the context of making enrolment offers.

Deputy Jim Daly asked the Minister for Education and Skills if, in his view, the Ombudsman for Children has a role in investigating any administrative decision made by a school board of management which has been the subject of a complaint to the ombudsman by a parent who believes the decision has affected his or her child negatively; and if he will make a statement on the matter. The statutory role and functions of the Children's Ombudsman are set out under sections 8 and 9 in the Ombudsman for Children Act, 2002. The Act empowers the Children's Ombudsman to investigate the administrative procedures followed by a school board of management provided the parent has firstly and fully followed the schools complaints procedures. The key criterion for any intervention by the Ombudsman is that a child has, or may have been negatively affected by the action of a school. As the Deputy is aware I am not satisfied with the current provisions of Section 28 of the Education Act 1998. I plan to revise it in order to provide in law for a Parent and Student Charter. I plan to consult with the Ombudsman for Children's Office on this matter.

Summer Works Scheme Applications

The Deputy will be aware that on 20th March last I announced that 386 schools have been approved funding under the Summer Works scheme to undertake school improvements. This first round of funding will allow schools to carry out small and medium scale building works across three categories of projects - Gas, Electrical and Mechanical.

A second round of the scheme is expected to be announced in the coming weeks within the context of available funding and in accordance with the prioritisation criteria outlined in the governing Circular Letter for the Scheme. This Circular Letter (59/2013) is available on my Department's website www.education.ie. This round will cover applications for improvement works yet to be assessed, including an application from the school to which the Deputy refers.

Student Grant Scheme Eligibility

Deputy Jonathan O'Brien asked the Minister for Education and Skills if a student who is awarded Irish citizenship mid-way through an academic year who previously was refused a Student Universal Support Ireland grant on the basis of nationality may be awarded partial grant assistance for the subsequent part of the year; and if he will make a statement on the matter. Article 32 of the Student Grant Scheme 2013 provides for the review of eligibility for the award of grant assistance in the event of changes of circumstances in the academic year, including a change in relation to a student's nationality or immigration status. This means that where a student acquires Irish citizenship by naturalisation, or is granted permission to remain, provided for in the Act or Regulations, during the course of their studies, he/she may apply to SUSI to have his/her application re-assessed. Any award the applicant may be eligible for as a result of a change in her immigration status will take effect from the date on which the change occurs.

Department of Education and Skills Circular 0007/2014 sets out the criteria for the allocation of teaching posts to primary schools for the 2014/2015 school year. The key factor for determining the level of staffing resources provided at individual school level is the staffing schedule for the relevant school year and pupil enrolments on the previous 30 September. The staffing arrangements include the provision whereby schools experiencing rapid increases in enrolment can apply for additional permanent mainstream posts on developing grounds, using projected enrolment for September 2014. The staffing schedule also includes an appeals mechanism for schools to submit an appeal under certain criteria, including developing grounds, to an independent Appeals Board.

In addition, the staffing appeals process at primary level has been extended for the coming school year to allow schools that are not gaining an additional teaching post under the developing schools criterion to submit an appeal to the Primary Staffing Appeals Board. This appeal criterion is targeted at those schools that make a significant contribution to the provision of school places and so assist the response to demographic growth within their area and, as a result, are under significant pressure on their class sizes at infants level. Circular 0007/2014 provides details for schools wishing to make an appeal.

The next meeting of the Primary Staffing Appeals Board will be held in June, 2014. The closing date for schools to submit an appeal application to the Department's Primary Allocations Section is Friday 30 May, 2014. It is open to the school referred to by the Deputy to submit an application(s) to my Department as outlined above.

Schools Building Projects Status

Deputy Michael Ring asked the Minister for Education and Skills the position regarding a school (details supplied) in County Mayo; when this school was first sought from the Department; if he will outline each stage of this application; the stage it is at now; the progress expected on this matter in the next number of months; and if this school was removed from any funding list in recent years. A major capital application for the amalgamated school to which the Deputy refers was received by the Department in February 2007. Both existing school sites were assessed and one of the sites was deemed suitable for development of a new school building.

The Design Team Appointment Process then commenced in June 2011 and was completed in January 2012. Stage 1 of Architectural Planning, which included initial sketch design, commenced in January 2012. In September 2012, the project proceeded to Stage 2(a) Developed Design, which involves development of the design to a stage where the documentation seeking the standard statutory approvals can be prepared. In January 2013, following a meeting between the School Authority and Department, the school was authorised to progress the project to complete Stage 2(b) that involves seeking all statutory approvals. Following receipt and consideration of the Stage 2(b) submission in November 2013, the project has been reserved for consideration for further progression i.e. to tender stage, pending additional funding being made available to my Department in the future. Due to competing demands on my Department's capital budget imposed by the need to prioritise the limited funding available for the provision of additional school accommodation to meet increasing demographic requirements, it is not possible to provide an indicative timeline for the further progression of this project at this time

School Curriculum

Deputy Luke 'Ming' Flanagan asked the Minister for Education and Skills further to Parliamentary Question No. 232 of 8 April 2014, where he states that schools also will respond in various ways to meet the diverse needs of pupils and to ensure that the history curriculum reflects the local environment and experiences of the local community in the past, the way the curriculum will differ for students studying in Castlerea and those studying in Ballaghaderreen; the person responsible for providing the various curricula for the various localities; if he has set up some sort of local rights commission that will draw the boundaries of the localities to which specific curricula are applied; and if he will make a statement on the matter. It is the responsibility of each individual school to decide on the most appropriate way to explore the personal and local history section of the History Curriculum for Primary schools. A close and detailed reading of the Primary History Curriculum and the Guidelines for teachers that accompany this curriculum will show that a number of suggestions are provided to teachers regarding this matter and I do not consider that any further guidance or control mechanisms are required.
