View answerEntitlement to Annual leave is laid down under the Organisation of Working Time Act, 1997. Annual leave is earned on all hours worked including overtime. An employee is entitled to 4 working weeks in a leave year where they have worked at least 1365 hours, or one third of a working week for each month in the leave year where they have worked at least 117 hours, or 8 per cent of the hours worked in a leave year (but subject to a maximum of four working weeks). The most beneficial of the calculations is the one that will apply where more than one option is possible but all are subject to a maximum of 4 working weeks. The employer decides when annual leave can be taken but must take into account the need for the employee to balance work and family responsibilities and the opportunities for rest and recreation available to the employee.
