Disability Allowance Payments

Questions (121)

Bernard Durkan

Question:

121. Deputy Bernard J. Durkan asked the Minister for Social Protection when disability benefit will be paid, including any arrears, in the case of a person (details supplied) in County Kildare; and if she will make a statement on the matter. [28936/14]

View answer

Written answers

As part of the Department’s ongoing review of payments a continuing eligibility (CE) certificate was posted to the person concerned on 28 May 2014 to complete and return. This form was returned marked “unknown at address”. There is an obligation on persons in receipt of a social welfare payment to inform the Department if they change their address and of any other change in circumstances that may affect their payment. As the Department was unaware of the whereabouts of the person concerned, his payment was suspended. The person subsequently notified the Department of his new address and a CE cert was re-issued on 2 July 2014 which the person should complete and return to the Department. In the meantime the suspension on his payment has been lifted and payment plus arrears due will be in his post office on 9 July 2014. In addition if the person concerned wishes to change his PO of payment he should inform the Department.

The Social Welfare Appeals Office has advised me that an appeal by the person concerned was registered in that office on 10 April 2014. It is a statutory requirement of the appeals process that the relevant papers and comments by or on behalf of the Deciding Officer on the grounds of appeal be sought from the Department of Social Protection. These papers were received in the Social Welfare Appeals Office on 28 May 2014 and the case has been referred to an Appeals Officer who will make a summary decision on the appeal based on documentary evidence presented or, if required, hold an oral hearing.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions in relation to social welfare entitlements.

For completeness, I wish to bring to the Deputy's attention that from time to time my Department also commissions engineering or environmental experts to provide technical reports on specific issues, as required. While the providers of these services are consultant engineers, environmental consultants or may describe themselves in other such terms, their work is not classified as consultancy services and is not funded from my Department's Administrative Budget.

I wish to advise the Deputy that information in respect of the members of the Board of the Loughs Agency from 2010 to 2014 can be found on the eGovernance website www.egovernance.ie or by contacting the Body directly. For the convenience of the Deputy, a list of the membership of the Board is set out in tabular form below.

Expenses arrangements are an operational matter for the Agency but I will bring the question to the attention of the Agency and ask that they respond directly to the Deputy on this matter. I am advised that the profession or occupation of board members is not recorded in the Department and I have asked the Agency to liaise with the Deputy directly in respect of this request. However if there is a particular issue in relation to skill sets that the Deputy wishes to raise, I would be happy to hear further from the Deputy.

Question:

I refer to my reply to Question No. 129 of 27 March 2014. The position is unchanged.

Inland Fisheries Ireland is and always has been prepared to assist search and rescue or recovery operations in practicable ways insofar that it can. The provision of funding to clubs as suggested in the question is not within it's statutory remit.

I can advise the Deputy that earlier this year I launched three development funds from IFI, totaling €410,000, aimed at supporting angling development and promoting conservation works. Each of the three funds has specific eligibility criteria attached and were generated from the angling community. The Salmon Conservation Fund, derived from the conservation stamp portion of the salmon and sea trout licence, is restricted to projects which benefit salmon conservation and is focused on Special Areas of Conservation (SAC’s) and on salmon rivers that require most development. The Midlands Fisheries Fund is derived from the midland permits charge paid by anglers and beneficiaries are restricted to the geographic area which this permit charge covers. The Co-op fund is the redistribution of residual funds from the Trout and Coarse Fish Development Societies accounts at the time of their dissolution. It was agreed that Co-op funds would be ring fenced and returned to the areas from which they were generated. I am advised that the application for funding for the Ballyleague Development Project is being considered from this fund. However I am further advised that, currently, the assessment process has not been completed. The assessment process will be completed in the coming weeks and I will advise the Deputy of the outcome in due course.

Since 2011 there has been a reduction of 18% in the total number of sick days taken in my Department and a 34% reduction in cost. This is due to the implementation of an Attendance Management Policy in my Department in 2011 which incorporates a stronger approach to the management and reduction of sick leave in the Department.

The Sustainable Energy Authority of Ireland (SEAI) administers the Better Energy Programme on behalf of my Department. This includes the Better Energy Homes scheme, the Better Energy Warmer Homes scheme and the Better Energy Communities scheme. Through these schemes grants are provided towards the cost of a range of measures including attic insulation, wall insulation, heating systems upgrades and solar thermal panels.

I am informed by the SEAI that any works carried out under these programmes are required to meet a specific technical standard. All products used by SEAI’s contractors meet appropriate national and international standards and have been tested to the highest standards. The technical specification sets out the materials to be used and the manner by which they are installed by the contractor. It deals extensively with the provision of ventilation in rooms and attic spaces to mitigate the known risks arising during energy upgrades. Further to this SEAI provides technical support to contractors through technical bulletins, on-line and on-site training.

The SEAI operates an inspection programme to ensure that any energy efficient measures installed meet the appropriate technical requirements including ventilation, construction methods and the construction material used. Through this programme a sample of work carried out by registered contractors is routinely inspected. The inspection programme has not shown up any widespread issue of dry rot. When an inspection does show up any specific issues these are dealt with directly with the homeowner and contractor. If any homeowner has a specific concern related to dry rot or any other issue they can contact the SEAI at 1850 927 000 who will examine the matter.

The Litter Pollution Acts 1997 to 2009 provide significant powers to local authorities to deal with the defacement of structures by writing or other marks. In addition to the legislative provisions for penalties for committing graffiti-related offences under section 19 of the 1997 Act and in order to provide support to local communities, my Department has provided funding for the Anti-Litter and Anti-Graffiti Awareness Grant Scheme, whereby local authorities are invited to submit proposed eligible projects to combat graffiti in their functional areas. It is open to local community groups to approach the local authority for assistance with funding for anti-graffiti projects.

The Department of Justice and Equality also has a role in the control of graffiti through the Criminal Damage Act 1991, which provides for the offences of damaging or defacing property.

The introduction of age-related restrictions on the purchase of spray paint to limit the availability of the product or discourage its inappropriate purchase could have an unfair impact on consumers who use the product for legally permitted purposes. Moreover, the administrative and regulatory burden arising from the introduction of such restrictions – for the public sector, industry and consumers – might well be disproportionate to any potential gains.

I understand from Irish Water that some €64.6 million has been expended on external service providers in relation to the establishment of the company. Decisions on specific operational expenditure are a matter for the company and I have no role in that regard. However, costs incurred by Irish Water will be examined by the Commission for Energy Regulation as an integral element of the independent economic regulation of Irish Water.

Irish Water has confirmed to my Department that it has established a dedicated team to deal with representations and queries from public representatives. The team can be contacted via an email to oireachtasmembers@water.ie or by telephone on 1890 278 278.
