Deputy Michael Lowry asked the Minister for Agriculture, Food and the Marine further to Parliamentary Question No. 462 if he will provide the information sought in relation to the total number of overclaim cases currently with the land parcel identification system section; the average processing time in resolving these cases; the number of Tipperary farmers awaiting a decision in their cases; his views that these delays are acceptable; the steps he will take to tackle these backlogs; and if he will make a statement on the matter. The Land Parcel Identification System database underpins the processing of applications under the Direct Payment Schemes. Payments made to date under the 2014 Single Farm Payment and Disadvantaged Areas Schemes amounts to almost €1.3 billion. The vast majority of farmers have been paid under both Schemes. Currently there are relatively small numbers of cases involving over-claims which are still not clear. These are cases where there are complex issues involved such as dual-claims and commonage over-claims. My Department is currently in correspondence with the applicants directly involved with a view is reaching a conclusion. There are 48 farmers in Tipperary who have over-claims including those relating to dual-claimed parcels and commonages.

Area-based schemes under the Rural Development Programme 2007-13 are subject to EU Regulations which require detailed administrative checks on all applications, including cross checks with the Land Parcel Identification System, to be completed before payments can issue. These rigorous procedures, together with on-farm inspections, apply to a number of scheme payments including the Agri-Environment Options Scheme (AEOS) and are necessary to ensure that applications meet the scheme conditions and cross-compliance requirements. All checks are now complete and AEOS 2 payments in respect of the 2014 scheme year will commence shortly.

The person named submitted a 2014 Single Farm Payment/Disadvantaged Areas scheme application on 31 March 2014. EU Regulations governing the administration of these schemes require that full and comprehensive administrative checks, including in some cases Remote Sensing (i.e. satellite) inspections, be completed before any payments issue. The EU Regulations also require that where it is not possible to make an accurate determination on the eligibility of a parcel or parcels of land by means of an assessment of the available satellite imagery, a field inspection must be undertaken to verify the eligibility of the land.

The application of the person named was selected for a Remote Sensing inspection. Initial processing of this inspection identified a requirement to verify the eligibility of land declared by means of a field inspection.

On completion of this inspection the results will be finalised with the intention of issuing any payment due as soon as possible. In the event that any queries arise officials in my Department will be in contact with the person named.

My Department received a 2014 Transfer of Entitlements application form on 15th May 2014 requesting the transfer of 7.18 Single Payment entitlements from a deceased person to the person named.

As this transfer was by way of inheritance, it was necessary to request testamentary documentation in support of this transfer. My Department has received the necessary documentation and the transfer of entitlements application has now been processed.

I am aware of certain issues involving the persons named, which have been fully examined on a number of occasions by my Department. All such investigations have concluded that the issues raised were of a private nature between the persons named and a third party. I am not aware of any Garda investigation into this matter.

Fishery Harbour Centres

Deputy John McGuinness asked the Minister for Agriculture, Food and the Marine the location of the various marine repair facilities operating from properties leased by the State and-or his Department; the number of properties available to let and in control of his Department or the State at Howth Harbour, County Dublin; if interest has been expressed in these properties by businesses for the purpose of a marine repair facility; if so, the number of queries his Department received; the number of meetings that were held with interested parties; if the properties were let; if not, the reason for same; and the length of time the properties have been vacant. My Department owns, manages and maintains six Fishery Harbour Centres located at Howth, Dunmore East, Castletownbere, Dingle, Ros an Mhíl and Killybegs. All six Fishery Centres are first and foremost working fishery harbours.  However each centre has unique features which facilitate a broad range of other diverse activities which are important from both and economic and social perspective. 

All of the Fishery Harbour Centres contain marine repair facilities provided by the Department however the synchrolift repair facility in Dunmore East is not currently operational due to the siltation problem in that harbour. In addition, private companies operating from premises in Howth, Castletownbere and Killybegs also provide marine repair services.

Properties located in the Fishery Harbour Centres, including Howth, are made available for tenancy under the relevant Government Procedures in place covering the management of State property. When appropriate, sites and properties are offered for tenancy under lease agreement by means of an open competitive tendering process in accordance with good practice and public procurement guidelines. In 2013, my Department held public competitive tendering processes for vacant sites in three Fishery Harbour Centres including Howth. These tender processes were open to all interested parties on an equal basis. The property in Howth was among the properties successfully tendered in this round.

Plans with regard to potential future uses for vacant properties at the Fishery Harbour Centres are kept under ongoing review by my Department. Consideration is given to demand for particular services should such demands become apparent, subject to public procurement guidelines as set out by Government. The current situation in relation to Howth is that there are some sites and properties not in use. A number of these on the East Pier would never be viable for commercial enterprise and others are subject to structural repair and other pre-tendering preparation issues before they can be made available.

There have been expressions of interest from individuals for a number of activities including a marine repair service. Where requested, interested parties have been met and the Government procedures for the disposal of State Property have been explained to these parties. Individuals who expressed an interest will be in a position to tender for the sites that become available in 2015.

Commission for the Economic Development of Rural Areas

The report of the Commission for Economic Development of Rural Areas (CEDRA) is a broad multi-sectoral document containing 34 recommendations on actions to be taken on areas as diverse as investment and finance, local enterprise support, rural towns, broadband, roads, social enterprise, building community capability, water, rural transport, artisan foods, creative industries, tourism & recreation, marine and renewable energy. Its operational scope requires an integrated response from a wide variety of agencies and Minister Phelan has established a high level Inter-Departmental Group (IDG), involving all the main departmental actors, to assist her in progressing the integrated implementation of the report. Statutory responsibility and funding for these CEDRA actions remains with the relevant lead Departments. They are continuing to fund the range of CEDRA actions, within their remit, which support economic development in rural areas. A wide and comprehensive funding framework is available for this purpose which includes major elements of the draft Rural Development Programme, LEADER, Rural Transport Programme, the Seafood Development Investment Programme and the wider enterprise, capability and community development initiatives operated by other bodies such as the Enterprise Ireland, IDA, Local Enterprise Offices, Local Development Companies, Educational Training Boards and tourism agencies.

In addition, on foot of recommendation 4 (c) of the CEDRA report, a new and additional allocation of €1million was provided in the 2015 Budget to establish a Rural Innovation and Development Fund, to pilot a small number of initiatives under the CEDRA report. Work on developing these proposals is progressing but have not yet been finalised.

My Department has been in correspondence with the person named for some time in relation to his allegations. My Department has at all times made it clear that responsibility for pursuing the allegations in question is a matter for investigation by An Garda Síochána. The Animal Health and Welfare Act 2013 was commenced on the 6th March 2014 and, arising from its commencement, all animal welfare matters now come within the remit of my Department. Accordingly, my Department is in a position to investigate allegations of animal abuse occurring since the commencement of the Animal Health and Welfare Act. However, as the Act does not have retrospective effect, matters which took place prior to 6th March 2014 and were not part of the remit of my Department at that time remain outside my Department’s competence.
