Housing Assistance Payments Implementation

125. Deputy Brian Stanley asked the Minister for the Environment, Community and Local Government if tenants in receipt of the new housing assistance payment will be removed from local authority housing lists. [45871/14]

The implementation of the Housing Assistance Payment (HAP) is a key Government priority and a major pillar of the Social Housing Strategy 2020, which I launched last week. The HAP scheme will bring all social housing supports provided by the State under the aegis of local authorities. The scheme will remove a barrier to employment by allowing recipients to remain in the scheme if they gain full-time employment. HAP will also improve regulation of the rented accommodation being supported and provide certainty for landlords as regards their rental income. Under section 19 of the Housing (Miscellaneous Provisions) Act 2009, as amended, HAP is deemed to be a social housing support and, consequently, households in receipt of HAP are not entitled to remain on the local authority waiting list for social housing support. However, HAP recipients may access other social housing supports by applying to go on the local authority transfer list.

HAP has been rolled out in seven local authority areas on a pilot basis. As an immediate step, I have issued a statutory direction to the seven authorities involved, instructing them to take the necessary steps to ensure that households benefiting from HAP can avail of a move to other forms of social housing support, should they wish to do so, through the transfer option. I have also directed that HAP recipients, who apply to go on the transfer list, should get full credit for the time they spent on the waiting list and be placed on the transfer list with no less favourable terms than if they had remained on the waiting list. In practice, housing authorities inform HAP recipients in writing of their entitlement to apply to go on the transfer list when they are approved for HAP.

Prior to the full roll-out of HAP, my Department will undertake a review of the transfer option with the seven pilot authorities. This will inform the overall review of the housing allocation system which is a key action under the Social Housing Strategy. Once the review is complete, I will make the necessary Regulations to ensure that the transfer option for HAP recipients operates consistently and effectively as part of the national roll-out of the new scheme.

Chapter 4 of Part 2 of the Housing (Miscellaneous Provisions) Act 2009, relating to rental accommodation arrangements, has not been commenced to date because it is dependent on commencement of section 31 of that Act concerning rent schemes and charges, which was amended in 2013 and in 2014. Commencement of section 31 is due to begin in the coming months and, when the provision is fully in operation, consideration will be given to bringing Chapter 4 of the 2009 Act into force, having regard to progress on the phased introduction of the Housing Assistance Payment scheme currently under way. Consideration will be given to commencing section 29 of the Housing (Miscellaneous Provisions) Act 2009 as part of the programme of key reforms in relation to the delivery of social housing supports, set out in the Social Housing Strategy 2020, published on 26 November last.

The Housing (Miscellaneous Provisions) Act 2014 was enacted in July and the majority of Parts 1, 4 and 5 have already been brought into operation. As indicated in the Social Housing Strategy 2020, I intend in the first quarter of 2015 to commence Part 2 of the Act, which introduces a new court procedure for the recovery of possession of local authority dwellings and strengthens the powers of housing authorities to obtain court orders to exclude persons engaged in anti-social behaviour from local authority accommodation and estates. Furthermore, I intend to commence Part 3 of the 2014 Act, relating to tenant purchase of existing local authority houses along the incremental purchase model, in the second quarter of 2015.

Homelessness Strategy

Deputy Gabrielle McFadden asked the Minister for the Environment, Community and Local Government the criteria his Department employs to allocate the national homelessness budget in view of the fact that the four midland counties of Laois, Offaly, Westmeath and Longford have continued to receive a 1.5% annual allocation of the national budget for many years despite a 12.27% reduction in this funding for the region in 2013. Statutory responsibility in relation to the provision of accommodation for homeless persons and related services rests with housing authorities. My Department provides funding to housing authorities towards the operational costs of homeless accommodation and related services under Section 10 of the Housing Act 1988. Housing authorities provide additional funding from their own resources. Funding from my Department has been substantially protected over the past number of years despite the wide-scale pressure for reductions in Government spending across all Departments. During 2013, €45 million was provided through my Department to housing authorities under Section 10 which represented a decrease of 3.32% on the 2012 outturn of €46.546 million. This reduction was applied equally to each of the 9 regional allocations for homeless services in 2013. In 2014, regional allocations were maintained at the same level as 2013 and €649,707, representing approximately 1.4% of the national budget, was allocated in respect of the Midlands Region.

The Budget 2015 announcement confirmed that an additional €10.5 million will be available, through my Department, for homeless accommodation and related services across the country in 2015. This is an increase in funding of over 20%, bringing the Exchequer contribution to €55.5 million. My Department is currently considering the appropriate allocation of this funding so as to ensure that Section 10 homelessness funding contributes to meeting the needs in the various regions. The additional funding will ensure continued progress toward the achievement of the 2016 target of ending involuntary long-term homelessness and will assist in meeting commitments outlined in the Implementation Plan on the State’s Response to Homelessness.

A proposal for a Government response to the recommendations in the Fifth Report of the Convention on the Constitution, that citizens resident outside the State and citizens resident in Northern Ireland be given the right to vote in Presidential elections, is being prepared in my Department. In line with the Oireachtas resolution establishing the Convention, the Government, when providing its response in the Oireachtas to the recommendations, would, if accepting the recommendation, indicate the timeframe envisaged for the holding of any related referendum.

Pyrite Remediation Programme

Deputy Clare Daly asked the Minister for the Environment, Community and Local Government in view of the emergence of pyrite in County Donegal and Dun Laoghaire-Rathdown, if he will bring forward legislation to amend the pyrite remediation scheme, in order that residents in these areas can be considered for inclusion. The Pyrite Resolution Act 2013 provides the statutory framework for the pyrite remediation scheme and while the Act provides that the scheme can be amended, replaced or revoked, this can only be done in accordance with the scope of the Act. The provisions of the Act apply only to dwellings affected by significant damage attributable to pyritic heave resulting from the presence of reactive pyrite in the subfloor hardcore material and not to damage arising in any other circumstances, such as the presence of contaminants in concrete blocks as appears to be the case in County Donegal. I have no proposals to amend the Act in this regard.

The scheme, which was published by the Pyrite Resolution Board in February of 2014, was developed having regard to the recommendations set out in the report of the independent Pyrite Panel and in accordance with the relevant provisions of the Pyrite Resolution Act 2013. The Panel was established in September 2011 to explore options for a resolution to the problem of pyrite in the subfloor hardcore material which at that time had manifested itself in dwellings in a number of areas. The Panel reported in July 2012.

Any proposal to amend the scheme would, in the first instance, be a matter for the Pyrite Resolution Board and any such proposal would require detailed consideration of the evidence deemed necessary to support the case for an amendment to the scheme. The recommendations of the Pyrite Panel to establish a pyrite remediation scheme to include dwellings in the functional areas of Dublin city, Fingal, Kildare, Meath and Offaly were premised on a number of pertinent factors and I would support the view that similar factors would need to be examined in advance of extending the scheme to other areas, given the scheme is ultimately one of last resort.

I refer to the reply to Question No. 318 of 14 October 2014 which sets out the information that would be required for the Board in order to consider an amendment to the scheme to include the functional area of Dun Laoghaire-Rathdown County Council.

Section 180 of the Planning and Development Act 2000, as amended, sets out the process by which local authorities can take in charge housing estates. A new Planning and Development Bill is currently in preparation, in which section 180 will be updated to improve and streamline the taking in charge process.

My Department is engaging with the City and County Management Association (Planning and Land Use Committee), Irish Water and other relevant stakeholders in the context of preparing for this new legislation, which it is intended will update the taking in charge process to both address legacy issues and take account of the proposed connections policy approach of Irish Water.

Pyrite Remediation Programme

The Pyrite Resolution Act 2013 provides for the making of a pyrite remediation scheme by the Pyrite Resolution Board for certain dwellings affected by significant pyrite damage. The report of the independent Pyrite Panel (July 2012) provides the framework for the remediation scheme and the eligibility criteria are reflective of the conclusions and recommendations of the report. The Panel was clear in its view that only dwellings with significant damage due to pyritic heave should be remediated and that it would be unreasonable to expect dwellings not exhibiting such damage to be included.

The scheme, which was published by the Board in February 2014, was developed having regard to the recommendations set out in the report of the independent Pyrite Panel and in accordance with the relevant provisions of the Act. One of the eligibility criteria under the scheme is that an application to the Board must be accompanied by a Building Condition Assessment with a Damage Condition Rating of 2. To date the Pyrite Resolution Board has received almost 600 applications, the vast majority of which have met this eligibility requirement.

Dwellings with a Damage Condition Rating of 1 with progression do not qualify under the scheme although some may be considered for inclusion at a later stage if the Board is satisfied that exceptional circumstances apply in accordance with the provisions of section 17 of the Act. I understand that all relevant information will be considered by the Board in advance of making any decisions in these matters.

The Quarterly National Household Survey (QNHS) is the official source of estimates of employment, unemployment and the labour force in the State. Estimates of unemployment are produced by NUTS3 Region. The South-West NUTS3 region comprises of Cork City, County Cork and County Kerry. Due to methodology and sample size it is not possible to produce reliable estimates from the QNHS at County level. The latest figures available from the QNHS are for Quarter 3 of 2014.

The Live Register series gives a monthly breakdown of the number of people claiming Jobseeker's Benefit, Jobseeker's Allowance and other registrants as registered with the Department of Social Protection. It should be noted that the Live Register is not a definitive measure of unemployment as it includes part-time workers, and seasonal and casual workers entitled to Jobseeker's Benefit or Allowance.

Table 1 shows the number of persons on the Live Register in County Kerry classified by age and duration of continuous registration in April of each year from 2008 to 2014. This breakdown is not currently available prior to April 2008.

Table 2 shows the number of persons on the Live Register in County Kerry classified by age in October of each year from 2004 to 2014.

Table 3 shows the number of persons aged 15 years and over classified by South West NUTS 3 region and ILO Economic Status in Quarter 3 of each year from 2004 to 2014.
