289. Deputy Bernard J. Durkan asked the Minister for Culture, Heritage and the Gaeltacht if legal clarification has been agreed in relation to whether uninterrupted turf cutting by two persons (details supplied) in succession since the 1970s on a plot unassigned by the Land Commission may be combined to give a 30 year right of prescription over the plot; and if she will make a statement on the matter. One of the individuals referred to in the Deputy's question appealed to the Peatlands Council against a decision of my Department that he does not fulfil the qualifying criteria to be eligible for compensation under the cessation of turf cutting compensation scheme. 

I understand that the Council has raised a legal issue and my Department has sought advice from the Office of the Attorney General on the matter.

The other individual referred to in the Deputy's question has also applied for compensation under the cessation of turf cutting compensation scheme.  I am advised that, as a similar legal question has arisen as regards both applications, my Department will take its decision on this application when the aforementioned advice has been received from the Office of the Attorney General.
