578. Deputy Clare Daly asked the Minister for Health the detail of plans to repeal section 85(6) of the Assisted Decision Making (Capacity) Act 2015 in view of the repeal of the eighth amendment of the Constitution. [25123/18]
View answerAs the Deputy will be aware, until the result of the recent referendum has been confirmed and the Thirty-sixth Amendment of the Constitution Bill has been signed by the President, termination of pregnancy is regulated by constitutional and statute law. When the referendum result is confirmed the Protection of Life During Pregnancy Act 2013 will remain the law on the issue until such time as new legislation regulating termination of pregnancy has been passed by both Houses of the Oireachtas.
Consideration will be given in relation to potential amendments that may be required to the provisions of section 85(6) of the Assisted Decision-Making (Capacity) Act in the context of the recent referendum result.
