242. Deputy Martin Heydon asked the Minister for Employment Affairs and Social Protection if a file for an appeal for partial capacity benefit for a person (details supplied) in County Kildare will be forwarded to the appeals office for processing; and if she will make a statement on the matter. Partial Capacity Benefit (PCB) allows a person who has been in receipt of Illness Benefit for six months and who may not have full capacity for work, to return to employment and continue to receive a partial or full payment from the Department.

The Partial Capacity Benefit file and relevant reports in respect of the person concerned was sent to the Social Welfare Appeals Office on the 9th January 2019.

The Social Welfare Appeals Office has advised me that the appeal by the person concerned will now be referred to an Appeals Officer who will make a summary decision on the appeal based on the documentary evidence presented or, if required, hold an oral hearing

I trust this clarifies the matter for the Deputy.
