321. Deputy Anne Rabbitte asked the Minister for Justice and Equality if a retrospective child abuse case deemed founded by Tusla is normally then investigated by An Garda Síochána or the DPP regardless of whether they investigated it previously; and if she will make a statement on the matter. The Deputy will appreciate that, in accordance with the Garda Síochána Act 2005 as amended, the Garda Commissioner is responsible for managing and controlling the administration and business of An Garda Síochána, including the investigation of allegations of criminal offences. Further, the Director of Public Prosecutions is independent in the exercise of her functions. As Minister, I have no role in such criminal investigations or decisions on prosecutions.

I have requested information from An Garda Síochána and will write directly to the Deputy when I receive it. Information in relation to Tusla may be requested directly from the Department of Children and Youth Affairs.
