Deputy Holly Cairns asked the Minister for Children, Equality, Disability, Integration and Youth if experienced data protection law experts will be engaged to oversee the processes by which survivors of mother and baby homes and other relevant persons can access their personal information from the mother and baby homes commission archive; and if he will make a statement on the matter. My Department is carefully examining the advice of the Attorney General and the views of the Data Protection Commissioner to ensure that we can put in place the procedures and practices that will enable relevant persons to access certain personal information. At this juncture, my officials are continuing to engage with the Attorney General and the Data Protection Commissioner to ensure that those procedures and practices will be robust, flexible, and will fully respect the rights of all data subjects, without prejudicing the operation of any future Commission of Inquiry.

As I indicated to the Deputy previously, as part of this ongoing process I am open to engaging with expert legal opinion on this matter.
