Guardian's Payment

Question:

488. Deputy John McGuinness asked the Minister for Social Protection if she will re-examine an application for guardianship payment that was refused in the case of a person (details supplied) with a view to allowing the claim; and if she will take into account that the grandparents were under extreme pressure at the time and had no assistance to deal with the issues even though Tusla was aware of the circumstances and the hardships being experienced. The person concerned applied for Guardian's Payment (Contributory) in April 2019. A letter issued to the person concerned on 23 April 2019, requesting further information, to which no reply was received. A reminder letter issued on 04 July 2019 but no reply was received. Subsequently an attempt was made to contact the person concerned by telephone, to no avail.

On 01 August 2019, having received no reply to our requests for information and in the absence of any contact from the person concerned, the application was disallowed.

If the person concerned would like to have their entitlement to Guardian's Payment examined, they should submit a new application.

I trust this clarifies the position for the Deputy.

Covid-19 Pandemic Unemployment Payment

The person concerned has had his eligibility for arrears of the Pandemic Unemployment Payment assessed and the sum of €3,339.00 has been approved for payment. This payment is due to be credited to the nominated bank account of the person concerned on 1st December 2020.

Community Employment Schemes

Employment Programmes such as Community Employment (CE) are labour market programmes that enable long-term unemployed to progress into employment and/or further education and training. Participation limits on these schemes are necessary to allow for the maximum utilisation of places amongst qualifying persons. It is important to note that participation is intended to be for a temporary fixed term and the positions offered are not full-time sustainable jobs. Instead, the placements are designed to break the cycle of unemployment and maintain work readiness, thereby improving a person’s opportunities of returning to the open labour market.

Following 12 months in receipt of a qualifying Social Welfare payment CE placements for those aged between 21 and 55 years will be for one year. However, if a CE participant is working towards a QQI Major Award or working towards a recognised industry standard, their time on CE can be extended up to a maximum of 3 years to complete the full award/qualification standard i.e. a total participation of 3 consecutive years in which to complete any outstanding modules.

The person concerned will have completed three years on CE in February 2021. During this period she has completed a number of QQI minor awards. The person concerned is presently completing a course which was delayed due to Covid 19 restrictions. On an exceptional basis funding for this participant will be extended to 26th March 2021 to allow her complete her current training.

The Department's Activation service will work with the person concerned to ensure that the skills and experience they received during their time on CE are maximised. This process will help identify potential employment opportunities and offer support to them in overcoming any barriers to employment.

The Department strongly supports the work being done through Community Employment schemes and the vital roles they are playing in local communities. Community Employment vacancies are advertised on www.JobsIreland.ie and are promoted and supported locally by the Department's Activation service.

Covid-19 Pandemic Supports

Deputy Niamh Smyth asked the Minister for Social Protection if she will review correspondence (details supplied); the reason those on incapacity payments are being refused the wage subsidy scheme by her Department having previously been in receipt of it during lockdown in March 2020 due to Covid-19; and if she will make a statement on the matter. The Government recognises the importance of supporting people with disabilities to access employment opportunities. Through the Comprehensive Employment Strategy, my Department is committed to improving employment outcomes and removing barriers to employment for persons with disabilities. The supports provided are designed to enable them to achieve their employment ambitions by focusing on the individual’s ability and capacity.

The Wage Subsidy Scheme is an incentive to encourage employers to offer substantial and sustainable employment to people with disabilities. It provides financial support to employers who offer employment of at least 21 and up to 39 hours per week.

Partial Capacity Benefit is payable to people who have been in receipt of Illness Benefit (for at least 6 months) or Invalidity Pension and wish to return to work, if their capacity for work is reduced by their medical condition.

The two schemes aim to improve employment outcomes for persons with disabilities, but they operate in different ways and have different qualifying conditions. The Wage Subsidy Scheme is targeted at employers, while Partial Capacity Benefit is targeted at the individual who wishes to return to work. Both are not payable in respect of the same employment position, i.e. an employer cannot receive the Wage Subsidy in respect of a person who is in receipt of a Partial Capacity Benefit payment. This is to avoid a situation whereby a dual subsidy is paid in respect of a single employment position, which would have significant cost benefit implications.

The published Wage Subsidy Scheme Operational Guidelines clearly state that where a potential employee is in receipt of a Partial Capacity Benefit, the person must come off that payment for the employer to avail of the Wage Subsidy Scheme. That position has not changed.

In this instance, it appears that the Wage Subsidy Scheme payment was made to the employer in error. When the error was discovered the payment was stopped.

I trust this clarifies the position for the Deputy.

Youth Unemployment

492. Deputy Paul McAuliffe asked the Minister for Social Protection the policy measures being taken by her Department to help young people secure employment particularly in areas of high unemployment; and if she will make a statement on the matter. [35105/20]

We know from past recessions that young people tend to be disproportionately impacted by any labour market shock. This is because many employers operate a "last in-first out" protocol when reducing their labour force and also because young people tend to work in occupations and sectors, such as retail and hospitality, that are most immediately affected by economic downturns. As research published recently by my Department shows, the impact of the Covid-19 pandemic has been no different.

Youth unemployment stood at just over 10% in Q1 2020 based on the Labour Force Survey data, with approximately 20,000 persons aged under 25 on the Live Register. By Q3 2020 these figures had increased to 20% and 25,000 respectively.

By end October, if PUP recipients are included in the figures, over 45% of young people in the labour force were unemployed. However, it is important to note that the Government extended access to PUP to students who worked part-time. As a consequence one in four of those in receipt of PUP, and under 25, have self-certified as students. Using internationally recognised standards set by the International Labour Organisation, these students would not normally be considered, or counted, as unemployed.

While young people are disproportionately affected we also know from past recessions that youth unemployment levels typically fall quite quickly once economic activity resumes.

The evidence also shows, however, that some young people will remain disconnected from employment and that those who cannot re-find their footing tend to suffer permanent scarring effects with unemployment and social isolation becoming entrenched.

That is why it is critically important that we act quickly and decisively to engage with young people who do not return to either employment or education, to create opportunities and options for them, to promote these options and to work with them to help them take up these options. As part of this approach it is also critically important to work with employers to encourage them to make opportunities available to young people who might not have the social and family networks that can sometimes be necessary to take that first step into employment.

That is why my Department, and the Department of Further and Higher Education, Research, Innovation and Science, are developing a range of support measures to assist persons, including young persons, on their journey to work. Measures announced under the July Jobs Stimulus to combat unemployment and youth unemployment, include:

- Expanding the capacity of Intreo Centres to provide enhanced employment services and supports with the assignment of 100 Job Coaches.

- Expanding the benefit of the JobsPlus recruitment subsidy to employers who hire young people from the Live Register.

- Providing 35,000 new places in further and higher education courses.

- Providing incentives to employers to take on more apprentices, with the provision of a grant of €3,000 to employers for each new apprentice recruited.

- Facilitating access to the Back to Education Allowance and Back to Work Enterprise Allowance to those displaced by the pandemic by waiving the usual qualifying period.

My Department is also developing a new work experience placement programme for those out of work for at least six months to encourage employers to provide jobseekers with the necessary workplace skills to compete in the labour market - to help break the vicious circle of 'no job without experience, no experience without a job'. I expect to launch the Programme in early 2021, subject to public health restrictions.

In developing these programmes and services the Department is working closely with, and being advised by, the Labour Market Advisory Council which is composed of leading market experts, representatives of industry and workers and representatives of unemployed people. We will keep these programmes under review and report progress on a regular basis.

Illness Benefit

Under the Health (Preservation and Protection and other Emergency Measures in the Public Interest) Act 2020 (No. 1), the Government, having regard to the manifest and grave risk to human life and public health posed by the spread of Covid-19, extended the provisions of the Social Welfare Acts to provide for entitlement to illness benefit for persons who have been diagnosed with, or are a probable source of infection with Covid-19. The purpose of the enhanced Illness Benefit payment in respect of COVID-19 is to encourage people to not go to work due to financial constraint when they should be in isolation.

As of November 25th 2020 there have been of 78,300 claimants for the enhanced Illness Benefit, and 74,700 of these have received payment. Sectoral data indicates that approximately 1,100 workers in pre-primary education and child day-care activities have been in receipt of an enhanced Illness Benefit payment since the introduction of the scheme.

Covid-19 Pandemic Unemployment Payment

The Pandemic Unemployment Payment (PUP) is available to the unemployed who lost their employment due to Covid- 19 and satisfy the scheme conditions. Self- employed individuals must have suffered a reduction in their trading income to the extent that they are available for full time employment.

The weekly rate is linked to prior weekly earnings. Individuals with prior earnings of €400 or more receive €350. Those with earnings of less than €200 receive €203. For earnings between €200 and €299.99 the rate is €250 and for earnings between €300 and €399.99 the weekly rate is €300.

Budget 2021 provided that self-employed PUP recipients can earn up to €480 over a rolling four week period and retain entitlement to PUP. The €480 limit is based on gross income, before tax and PRSI, minus expenses. If they exceed this threshold and work up to 24 hours per week they may be eligible for support under the Part Time Job Incentive scheme which has been extended to the self-employed who transition from the PUP. The weekly personal rate of payment is €128.60.

A person engaged in limited employment may apply for a jobseeker's payment depending on their circumstances. The weekly rate of payment is €203 and increased allowances are paid for qualifying adults and child dependents.

Financial support is also available under the means-tested Supplementary Welfare Allowance scheme.

Covid-19 Pandemic Unemployment Payment

496. Deputy Thomas Pringle asked the Minister for Social Protection the qualifying criteria for recipients of the pandemic unemployment payment to qualify for the Christmas bonus for social welfare recipients; and if she will make a statement on the matter. [40265/20]

The Christmas Bonus will be paid in the week beginning 7th December to social welfare recipients, such as pensioners, people with disabilities, carers and lone parents in recognition of their long-term financial dependence on social welfare payments for all, or most, of their income.

In recognition of the impact that the Covid-19 pandemic has had on employment levels and the sudden financial impact on individuals, the Bonus will be paid this year, on an exceptional basis, to people in receipt of the Pandemic Unemployment Payment for a period totalling 17 weeks or more and who are in payment on the date the Bonus is paid. It will also be paid to people on jobseeker payments who have been in receipt of these payments for four months or more.

As the PUP payment week runs from Friday to Thursday, any person in receipt of PUP for any one day of the period Friday, 27th November to Thursday, 3rd December, will receive the Christmas Bonus payment on Tuesday, 8th December as long as they have accrued 17 weeks on the payment in total.

In total, the Bonus will be paid to 1.6 million people, at a cost of €390 million.

Working Family Payment (WFP) is an in-work family payment which provides additional income support to employees on low earnings with children, relative to family size.

An application for WFP was received from the person concerned on 17 February 2020. Their application was referred to a Social Welfare Inspector (SWI) for clarification on 02 March 2020 as it was not possible to carry out a full assessment of their entitlement based on the information provided by the person concerned.

In the meantime and as a consequence of public health restrictions imposed due to the Covid pandemic and the nature of the inspection, the SWI investigation has been delayed. The SWI has been contacted and has confirmed that their report will be completed as a matter of urgency.

On receipt of the completed report from the SWI, the application for WFP will be processed without delay and the person concerned will be notified in writing of the decision.

Following a review of the entitlement of the person concerned, it was found that she had a decrease in her means from 18 March 2020. Based on the information provided to my Department, an increased rate of disability allowance (DA) was awarded.

The first payment will be made to their chosen payment method on 2 December 2020. A letter issued to the person concerned informing her of this on 26 November 2020. Arrears of payment due have issued to the person concerned.

Covid-19 Pandemic Unemployment Payment

From last March to June 29th last the Pandemic Unemployment Payment was paid at a flat rate of €350 per week.

From June 29th the Pandemic Unemployment Payment was paid at two different rates and this rate was linked to an employee's average gross weekly earnings in 2019. If the average was greater than €200 per week in 2019 then the appropriate Pandemic Unemployment Payment rate was €350pw.

From September 17th last the Pandemic Unemployment Payment was paid at 3 different rates and, again, this rate was linked to an employee's average gross weekly earnings in 2019. If the average was between €200 and €300 per week in 2019 then the appropriate Pandemic Unemployment Payment rate was €250pw.

Since October 15th there are 4 different rates of Pandemic Unemployment Payment and, again, this rate is linked to an employee's average gross weekly earnings in 2019. If the average was between €200 and €300 per week in 2019 then the appropriate Pandemic Unemployment Payment rate was €250pw.

Having reviewed the details of the Pandemic Unemployment Payment of the person concerned, my Department is satisfied that the correct rate has been paid to the customer since September 17th last for the reasons outlined above. However, if the customer wishes to have his payments reviewed he should forward a request for same, along with supporting documentation, to puprerate@welfare.ie or PUP Rerate, Department of Social Protection, Cork Road, Waterford.

Community Employment (CE) projects are typically sponsored by groups wishing to benefit the local community, namely voluntary and community organisations and, to a lesser extent, public bodies involved in not-for-profit activities.

Schools are not permitted to sponsor CE schemes and CE participants cannot be employed by or work in schools. This includes the provision of cleaners, caretaking/maintenance and other services to schools. As the Deputy may be aware, FAS who had responsibility for CE up until 2012, withdrew the CE services from schools from September 2001. As a result, the budget for schools-based CE schemes was transferred to the Department of Education and Skills.

My colleague, Minister Norma Foley T.D. has overall responsibility for the services and initiatives provided for by the Department of Education, including policy and funding.

Carer's Benefit

The Government acknowledges the crucial role that family carers play and is fully committed to supporting carers in that role. This commitment is recognised in both the Programme for Government and the National Carers’ Strategy.

The main income supports to carers provided by my Department are Carer’s Allowance, Carer’s Benefit, Domiciliary Care Allowance and the Carer’s Support Grant. Combined spending on all these payments to carers in 2020 is expected to exceed €1.3 billion.

Carer's Benefit is a payment made to insured people who may be required to leave the workforce or reduce their working hours to care for a person(s) in need of full time care.

Under the provisions of the legislation, to be eligible to claim Carer's Benefit, a claimant must have been employed for at least 8 weeks, whether consecutive or not, in the previous 26 week period. They must also meet certain PRSI contribution conditions and have, for example, at least 156 PRSI contributions paid at any time between entry into insurance and the time the claim for Carer’s Benefit is made. Any change to these requirements would require legislative amendment.

It should be noted that for persons who are in receipt of the Pandemic Unemployment Payment (PUP), or who are employees in respect of whom employers are claiming a subsidy under the Temporary COVID-19 Wage Subsidy Scheme operated by the Revenue Commissioners, will for a prescribed number of weeks, receive full social insurance contributions at the same class that they were paying immediately prior to their employment being impacted by the Covid-19 pandemic.

Carer's Allowance is a means tested payment made to people whose income falls below certain limits, and who are looking after certain people in need of full-time care and attention. This allowance is not based on the claimant’s employment record.

Any proposal to amend entitlement to Carer’s Benefit would require legislative change and would have to be considered in a budgetary context, taking account of current economic circumstances.

Paternity Leave

While there are no plans to extend Paternity Leave and Benefit beyond the existing duration of two weeks, fathers will be able to avail of the extension to Parent's Leave and Benefit from two weeks for each parent to five weeks, as provided for in Budget 2021. This extension will be made available retrospectively to parents in respect of all children born or adopted on or after 1st November 2019.

The extra weeks leave will be made available as soon as the necessary legislation, which is being drafted by the Department of Children, Equality, Disability, Integration and Youth, is enacted. I understand that the draft Heads of legislation are now at an advanced stage and are expected to be brought to Government shortly. The legislation will provide also for the necessary parallel changes required to the Social Welfare Consolidation Act.

Significant changes are required to the Department's systems to administer this extension, including the provision of retrospective entitlement. This work needs to be undertaken so that is does not compromise existing supports in an environment where there are unprecedented levels of demand on the Department’s services due to Covid-19.

Once the new application and payment system goes live in April 2021, my Department will process and issue benefit payments, to include backdated payment of benefit as appropriate, in respect of Parents Leave taken from the date of enactment.

An application for the Living Alone Increase was received from the person concerned on 15 November 2020. The increase was awarded with effect from 16 May 2020, backdated six months from date of receipt, in line with social welfare legislation. The person was notified of this decision on 16 November 2020.

Further backdating of this allowance beyond six months may be considered where the delay in making the claim was due to incorrect information provided by an officer of my Department, or due to the person being so incapacitated that they were unable to make a claim, or appoint a person to act on their behalf.

If the person concerned wishes to provide such additional information for review of their application on these grounds, they should write to my Department with documentary evidence.

They may also appeal the decision of 23 November 2020 by writing within 21 days to the Chief Appeals Officer, Social Welfare Appeals Office, D’Olier House, Dublin 2, stating clearly their grounds for appeal.

Covid-19 Pandemic Supports

The Covid-19 Pandemic Unemployment Payment was introduced as a support to employees who lost their employment as a direct consequence of Covid-19. It is also available to self-employed persons who can demonstrate that their income ceased, or reduced, as a direct consequence of Covid-19, to the extent that they would be available to take up full-time employment.

The Covid-19 Pandemic Unemployment Payment was placed on a statutory footing as a social welfare benefit in its own right from 5 August 2020 under the Social Welfare (Covid-19) (Amendment) Act 2020.

There is a requirement under social welfare legislation that persons must claim their entitlements within a specific period from the date their entitlement arises. The requirements in respect of the Covid-19 Pandemic Unemployment Payment are the same as those which apply to Jobseeker payments generally. A person must submit their claim on their first day of unemployment. However, reasonable regard is had to issues such as postal delays. In addition, incomplete claims which are received or which cannot be initially processed are always taken from the date of initial receipt. A claim may be backdated for up to six months where a person can prove to the satisfaction of a Deciding Officer or Appeals Officer that they satisfied the qualifying conditions throughout the period and that there was good cause for the delay in making their claim.

The person concerned applied for the Pandemic Unemployment Payment on 18/08/2020 and her claim was awarded from that date. If she can provide information to the Department as to the reason for the delay in applying, that information can be reviewed at that point. The Deputy may wish to forward this information to the Mid West Divisional Office in Limerick for initiation of the review process.

Fuel Allowance

506. Deputy Bernard J. Durkan asked the Minister for Social Protection the number of applications for the fuel allowance allowed and disallowed in each of the past eight years to date; the main reason for refusal; and if she will make a statement on the matter. [40474/20]

The Fuel Allowance is currently a payment of €24.50 per week for 28 weeks from October to April, at an estimated cost of €261.35 million in 2020. The purpose of the payment is to assist qualifying households with their winter heating costs. The allowance represents a contribution towards their heating costs and is not intended to meet these costs in full. Only one allowance is paid per household.

In Budget 2021, I announced an increase of €3.50 in the weekly rate of Fuel Allowance payable with effect from 4 January 2021. This increase takes account of the increase in carbon tax on solid fuels from May 2021 and allows recipients to benefit from the increased payment rate over this winter period.

Current figures indicate that approximately 369,000 households are in receipt of Fuel Allowance. Those who qualified for Fuel Allowance last year automatically receive the payment this year, provided they continue to fulfil the eligibility conditions, and do not need to re-apply.

Due to the administration of Fuel Allowance payments across different IT platforms, accurate numbers of claims received and disallowed are not readily available. However, approximate numbers of claims awarded and disallowed for the last eight years and to date in 2020 are provided in the table below.

Eligibility for fuel allowance is assessed based on a means test, a household composition test and only one allowance payable per household. While no breakdown of disallowance reasons is available, a claim will be disallowed where one or more of these conditions is not met.

Where a person does not qualify for Fuel Allowance but has significant outgoings and exceptional heating needs due to ill health or infirmity, they can apply for a heating supplement, a support paid under the Supplementary Welfare Allowance scheme. Each claim is assessed taking into account the individual circumstances of the case.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions in relation to social welfare entitlements.

The information required by the Deputy in relation to average waiting times for schemes that are subject to appeal is set out in the attached table below.

The time taken to process an appeal reflects all aspects of the appeal process, including the time spent in the Department preparing the appeal submission. The quasi-judicial nature of the system impacts on appeal processing times which are proportionate to the complexity of many of the issues under appeal.

There has been a decrease in overall processing times to date in 2020 with appeals requiring an oral hearing taking an average of 26.7 weeks (26.9 weeks in 2019) and summary decisions taking 15.8 weeks (22.1 weeks in 2019) to finalise. Given the nature of the payment, Supplementary Welfare Allowance appeals are prioritised at all stages of the appeal process. During 2019 it took an average of 17.6 weeks for those appeals to be decided summarily and 27.8 weeks to determine those appeals requiring oral hearing. For the period January to October 2020 the figures are 13.9 weeks for summary appeals (94% of the total) and 28.3 weeks for appeals requiring an oral hearing (6% of the total).

At the end of 2019 there were 8,788 appeals waiting to be determined. The number of appeals waiting to be determined at the end of October 2020 was 5,944 (a reduction of 32%). Processing times will continue to be a key focus of the Chief Appeals Officer.

I am advised by the Chief Appeals Officer that it is currently not possible to facilitate in-person oral hearings due to Covid-19 restrictions. The Social Welfare Appeals Office has recently commenced conducting online appeal hearings. In addition, appeal hearings are being conducted via telephone, where suitable. Appeals are also being determined on the basis of written submissions.

The 2020 Further Revised Estimates voted on by the Dáil on Wednesday, 18th November 2020 provides for an allocation of €5,094.4 million for the Pandemic Unemployment Payment (PUP), €1,740 million for the Employee Wage Subsidy Scheme (EWSS) and €74 million for Covid-19 Illness Benefit.

Based on trends up to end of November 2020, the budget for the Department will be adequate to meet demands arising from the Covid-19 pandemic.

My Department is committed to providing a quality service to all its customers, ensuring that applications are processed and that decisions on entitlement are made as quickly as possible.

There are no significant backlogs in the Department's scheme areas at present. All scheme areas are mainly up to date on claim processing and any backlogs are currently being worked down.

I can assure the Deputy that claim processing is kept under active review, with all possible steps taken to ensure good customer service.

The State Pension (Contributory) is a PRSI-based pension, financed by contributions made by current workers and their employers, and paid to pensioners, at a rate based upon their PRSI record when working. A person is required to have a minimum of 520 paid reckonable PRSI contributions in order to qualify for the State Pension (Contributory). As the actuarial value of the State Pension is estimated at over €300,000, it is reasonable to require people claiming a contributory pension to have made at least 10 years of paid contributions over the term of a working life.

Those with few or no PRSI contributions paid over the years may instead qualify for the State Pension (Non-Contributory), which is a means-tested pension, financed by the Exchequer, and paid at up to 95% of the maximum rate of the State Pension (Contributory). There are significant disregards in the household means test for the State Pension (Non-Contributory). Alternatively, if a person's spouse has a contributory pension, they may qualify for an increase for a Qualified Adult (based on their own means), amounting up to 90% of a full rate State Pension (Contributory). The most advantageous payment for a pensioner will depend upon their individual circumstances.

The Government approved the establishment of the Commission on Pensions earlier this month, in fulfilment of a Programme for Government commitment. The Commission will examine sustainability and eligibility issues in respect of State pension arrangements and will outline options for the Government to address issues such as qualifying age, contribution rates, total contributions and eligibility requirements. In line with the Programme for Government, the Commission will report to me on its work, findings, options and recommendations by 30th June 2021. The Government will take action having regard to the recommendations of the Commission within six months.

Decisions in relation to entitlement to social welfare payments are bound by the relevant provisions of the Social Welfare Consolidation Act, 2005 (as amended) and associated regulations. Every claimant is entitled to have their claim considered in accordance with the principles of natural and constitutional justice and in the context of determinations of entitlement under social welfare legislation. This does not vary at any point in the claim process - whether it is in the initial assessment of the claim, the decision to award or reject a claim, or a review of a claim decision.

My Department is committed to providing a quality service to all of its customers. This includes ensuring that reviews of decisions on social welfare claims are processed as soon as possible, and that the outcomes are notified promptly. At all times, every effort is made to complete the reviews as efficiently as possible.

Decisions are not delayed unnecessarily once all the information requested from the customer is made available to my Department. The review process does not result in claim suspension unnecessarily and all customers are afforded every opportunity to engage with my Department during the review.

Undue hardship for customers should not arise if there is ongoing co-operation from the customer with the deciding officer in my Department. This applies across all schemes payment areas. In the event that a delay occurs which results in financial hardship, a customer may apply for support under the supplementary welfare allowance scheme subject to the rules of that particular scheme.
