131. Deputy Catherine Connolly asked the Minister for Finance the number and value all procurement contracts that took place by way of negotiated procedure without prior publication in 2020 and to date in 2021; and the date, value and purpose of each negotiated procedure contract in tabular form. I wish to advise the Deputy that as per the Public Procurement Guidelines for Goods and Services my Department has not utilised, in 2020 or 2021 to date, the ‘negotiated procedure without prior publication’ which is one of the six procedures for awarding of contracts of values over EU Threshold (€139,000). The Negotiated Procedure without Prior Publication is an exceptional procedure and can only be used in a limited number of defined circumstances as set out in Regulation 32 of the European Union (Award of Public Authority Contracts) Regulations 2016, and the circumstances for utilising this procedure has not arisen for the Department.
