383. Deputy Bernard J. Durkan asked the Minister for Justice the best procedure for a person (details supplied) to follow in order to obtain citizenship; and if she will make a statement on the matter. [5770/22]

The granting of Irish citizenship through naturalisation is governed by the provisions of the Irish Nationality and Citizenship Act 1956, as amended. All applications are processed in line with the eligibility criteria set out under that Act. Each application is assessed individually and a determination on whether an applicant satisfies the statutory criteria attendant to naturalisation can only be made after an application is received.

Applicants are required to have five years reckonable residence in the State prior to making an application, except for spouses of Irish nationals where the requirement is three years. In both cases, the final 12 months must be continuous residence in the State with up to six weeks allowed to facilitate foreign travel for business family or holiday purposes.

Applications for naturalisation received by my Department are processed in chronological order. The application for the person referred to by the Deputy will be registered in the coming weeks. Following initial assessment of the application, an application reference number will be issued by my Department.

My Department is taking a number of steps to speed up the processing of applications and a number of digitisation measures have also been introduced to increase efficiency in the process, including eTax clearance, eVetting and online payments. The end result of the digitisation process will be to free up more staff to focus on processing applications in a timely and efficient manner, to improve service to our customers and reduce waiting times. From the beginning of this year, applicants are no longer required to submit their original passport with their initial application.

In 2021, my Department issued 11,512 citizenship decisions, which is the highest number of decisions made since 2015, and reflects positively the significant changes undertaken to date. Additional staff have also been assigned to the citizenship team. Based on these measures, my Department's objective is to achieve an improved timeframe of 6-9 months for decisions on a majority of applications during 2022.

This application for naturalisation from the person referred to by the Deputy, continues to be processed with a view to establishing whether the applicant meets the statutory conditions for the granting of naturalisation and will be submitted to me for decision in due course.

The granting of Irish citizenship through naturalisation is a privilege and an honour which confers certain rights and entitlements not only within the State but also at European Union level and it is important that appropriate procedures are in place to preserve the integrity of the process.

It is recognised that all applicants for citizenship would wish to have a decision on their application without delay. However, the nature of the naturalisation process is such that, for a broad range of reasons, some cases will take longer than others to process. In some instances, completing the necessary checks can take a considerable period of time.

In addition, the combined impact of the 2019 High Court judgment in the Jones case and the necessary health restrictions arising from the pandemic, has unfortunately resulted in the processing time for standard applications increasing.

A letter requesting further documentation was sent to the applicant's solicitor by my Department on 28 January 2022. Upon receipt of a response and the documentation requested, the application will be processed further.

Additionally, it remains open to the person concerned to apply for a change of their immigration status while their citizenship application is pending. If the change of status is approved it would enable them to seek employment based on the terms of the stamp granted. An EU Treaty Rights review application was received from the person referred to by the Deputy on 5 February 2020. This review is in respect of a decision made in January 2020 to revoke their residence card as a family member of an EU citizen. While this review is underway, the person concerned has been granted temporary permission to reside in the State. As a determination has not yet been made on this person’s review, it would be premature to consider whether their case may or may not fall under the Chenchooliah judgment. The person referred to by the Deputy holds a Stamp 4 immigration permission, which is valid until 14 July 2023. Therefore, there is no further requirement on them to regularise their permission until that date.

The Regularisation of Long Term Undocumented Migrants Scheme which opened for applications on the 31 January 2022 is only open to those who do not have a current permission to reside in the State.

All applications for a certificate of naturalisation are processed in line with the eligibility criteria as set out under the Irish Naturalisation and Citizenship Act 1956, as amended. Each application is assessed individually in accordance with the provisions of the Act. A determination on whether an applicant satisfies the statutory criteria attendant to naturalisation can only be made after an application is received, including any discretionary powers.
