496. Deputy Catherine Murphy asked the Minister for Children, Equality, Disability, Integration and Youth if his attention has been drawn to a case (details supplied) in which a person in unable to return to work for a service provider engaged by Tusla; if he will review in conjunction with Tusla the case file; if the person will be provided with a copy of the allegations made; and if he will further direct Tusla to engage with the service provider in order to facilitate the return to work of the person. I have not been notified of this case due to Tusla, the Child and Family Agency, being independent in the performance of its functions. This independence is required by law as set out in Section 8(11) of the Child and Family Agency Act 2013, that 'the Agency shall be independent in the performance of its functions'.

However, I have referred the question to Tusla for direct response to the Deputy as the matter raised is an operational matter for Tusla.
