Bell I move amendment No. 9: In page 18, line 43, to delete "carry on an adventure activity" and substitute..."act as an adventure activities operator"....Having had further discussion on this, it is my opinion that, in this regard, the Bill has a very serious...I appeal to the Minister of State to listen to what I have said about this very serious flaw in the Bill...Otherwise, he may be left with a Bill containing a very serious legal flaw.

for Occupational Safety and Health, national governing bodies for adventure activities, a representative...of the staff of adventure activities operators and persons having such knowledge, skills or experience...would so misbehave themselves as to merit dismissal, then he should provide for that in the Bill....Under it the Minister can at any time dismiss the chairperson and any member of the authority....Under another provision in the Bill the Minister could also fire the director.

Byrne I understand why the Deputy puts forward these suggestions as regards membership of the new authority...Since publication of the Bill my Department has received a number of comments from within the sector...as to the membership of the authority....that will match standards anywhere else in the world....working group and endorsed by the Association for Adventure Sports in the blueprint document it produced

In introducing this Bill, I am conforming to the necessity for a Bill for water-based activity centres...This Bill proposes a new licensing and policing system under the aegis of the Health and Safety Authority...Currently, the Association for Adventure Sports, AFAS, does a good job in setting standards for adventure...I am not saying that under this Bill the Association for Adventure Sports standards should be abolished...In 1995 the British Government introduced a Bill to regulate activity centres.

The purpose of the Bill is to put safety first....hope as a consequence there will be greater awareness of the necessity for safety measures in all the activities...The Bill came about as a result of an accident at sea....Adventure sports, by their nature, involve risk and that risk is the attraction....As Senators said, we are all becoming more health conscious and want to engage in these activities.

It will also take over the safety functions in relation to pleasure craft and adventure activities at...It is my intention that work will now be progressed under the directorate to have the new adventure activities...standards authority established as quickly as possible.

Belton I compliment Deputy Finucane on bringing forward this important Bill....The Bill can only help to further this aim...., proper safety standards are both desirable and necessary....to a voluntary code of safety standards devised by the Association for Adventure Sports....Resources in co-operation with the Health and Safety Authority.

Finucane I am pleased with the Minister's statement that there will be no dilution of safety standards...because of the exemptions to the Bill....The area of adventure centres must be looked at because responsibility for them is very diluted....responsibility, nor does the Minister, even though many of them are concerned with exclusively marine related activities...Although it does excellent work and tries to issue safety standards, etc., there is no underpinning legislation

Such charges are at the root of the problem with this Bill....will result from this legislation whereby one group of operators will be outside the ambit of the Bill...The activities involved are fringe pursuits and do not have significant resources....accepted, schools and vocational education committees which operate on a shoestring regarding outdoor and adventure...activities would also be funded by the Government.
