CEISTEANNA—QUESTIONS. - DAIL DECREES.

TOMAS MAC EOIN

To ask the Minister for Home Affairs whether it is the intention of the Minister to notify Justices of the existence of the several Decrees of Dáil Eireann which, until rescinded by the Dáil, have the force of law.

Mr. KEVIN O'HIGGINS

Without accepting this statement, in the last portion of that sentence I have to point out that none of the Decrees of Dáil Eireann affect matters which come within the jurisdiction of the new Justices.

TOMAS MAC EOIN

What about the old Justices? Are they going to continue? The County Court Judges, for instance?

Mr. KEVIN O'HIGGINS

Well, County Court Judges, like every other citizen of the country, are presumed to know the law.

TOMAS MAC EOIN

Does that mean the law we have inherited from the last Dáil?

Mr. KEVIN O'HIGGINS

We know what is, or what is not, the law of the country is a question of fact, which it will be for the Judges to decide.

TOMAS MAC EOIN

Are we to take this as a renunciation of the decrees of the last Dáil?

Mr. KEVIN O'HIGGINS

No, sir.
