In Committee on the Constitution of Saorstat Eireann Bill. - SECTION IV. THE JUDICIARY.

Article 63 reads:—"The judicial power of the Irish Free State/Saorstát Eireann shall be exercised and justice administered in the public Courts established by Parliament/ Oireachtas by judges appointed in manner hereinafter provided. These Courts shall comprise Courts of First Instance and a Court of Final Appeal, to be called the Supreme Court (Cúirt Uachtarach). The Courts of First Instance shall include a High Court (Ard Chúirt), invested with full original jurisdiction in and power to determine all matters and questions, whether of law or fact, civil or criminal, and also Courts of local and limited jurisdiction, with a right of appeal as determined by law." It is intended to call together quite soon a Judicial Committee to revise the entire system of justice in the country. It is hoped to evolve an entirely new Judicial System, which will supersede both the British Courts and the Dáil Courts, as formerly known. The Committee will, of course, aim at absorbing whatever is best in both of these systems. The new system will be set up in relation to Irish requirements, and it will be the aim of the Committee to set up a system of justice which the people can really regard as their own, and as suited to their needs and their genius. I move that Article.
