Vol. 2 No. 40

CEISTEANNA—QUESTIONS. [ ORAL ANSWERS. ] - FERMOY FATALITY.

To ask the Minister for Finance if he is aware that on the 22nd December last Dr. R.S. Baylor, of Fermoy, died from wounds received when he was lured from his home by masked men; if he is aware that the late Dr. Baylor acted as a servant of the State in local Referee Courts and as solicitor for the Troops in Fermoy area; if any claim for compensation has been made on behalf of his widow and three young children; and, if so, what was the result?

I am not aware of any claim in this case, but if one is made it would appear to be one which should be dealt with by the Personal Injuries (Compensation) Committee.

Is it not reasonable to expect that this man, who lost his life while acting as solicitor for the Army in Fermoy, would be looked upon indirectly as a servant of the State?

I do not know, nor is there any information conveyed in the question as to his particular capacity as a servant of the State. I take it that we are all servants of the State, but as regards the State's liability for our services that is another matter.

I have a letter from the widow of this gentleman, and if I send it to the President will he undertake to give it consideration?

Certainly.
