COMMITTEE ON PROCEDURE.—SECOND REPORT.

By your direction, A Chinn Comhairle, I present to the Dáil the Second Report of the Committee on Procedure, over which you presided.

In submitting herewith to the Dáil for consideration a further Report of their proceedings, the Committee on Procedure authorise me to make the following observations thereon.

Tá molta an Choiste le fáil sa Sceideal a ghabhann leis seo, atá roinnte ina dhá chuid. Sa chéad chuid tá roinnt Orduithe nua'na molann an Coiste glaca leo. Gheofar roinnt rudaí nua ann. Tá rialacha ann, cuir i geás, chun na himeachta a théigheann roimh thograchán an Chinn Chomhairle i nDáil nua do rialú, Tá cnósach eile d'órduithe ann a rialuíonn an tslí chun deighleáil le Tairisgint chun Dul chun an Chéad Ghnótha Eile. Tugadh isteach dhá riail airgeadais tháchtacha: ceann a shrianuíonn an díospóireacht ar Mheastacháin bhreise, agus ceann a thugann comhacht chun polasaí generálta Aire, i dtaobh Aireachta, do phlé gan aon Iteam fé leith do tharrac anuas. Deighleálaid orduithe eile acu leis an dTigh do chó-dhéanamh, le riteanna do chur amach, agus le tuairiscí d'fháil ón gCléireach. The recommendations of the Committee are contained in the accompanying Schedule, which is divided into two parts. The first contains some new Orders of which the Committee recommend the acceptance. Some fresh subjects are introduced. Thus, rules are submitted governing proceedings prior to the election of the Ceann Comhairle in a new Dáil. A further group of Orders regulate the method of dealing with the motion to proceed to the next business. Two important financial rules are introduced: one imposing restrictions on the debate of Supplementary Estimates; the other enabling the general policy of a Minister in respect of a Department to be discussed without involving a particular item. Other Orders deal with the matter of constituting the House, and with the issuing of writs, and the receiving of reports from the Clerk. The second part of the Schedule contains some further amendments to the existing Orders.

On the 22nd March, 1923, a Message from the Seanad was received by the Dáil requesting approval of the Dáil to a Joint Committee on Standing Orders, with a view to the adoption of agreed Standing Orders regulating inter-communication between the two Houses. In consequence of this it was resolved by the Dáil:—

“An Teachtaireacht ó Sheanad Eireann do chur chun an Choiste um Nós-imeachta chun pé ní is dó leo is fearr do dhéanamh ina thaobh.”

“That the Message from Seanad Eireann be referred to the Committee on Procedure to take such action thereon as they consider advisable.”

In pursuance of this instruction the Committee met the Standing Orders Committee of the Seanad on the 18th April. The representatives of the Seanad brought forward proposals bearing on the following subjects:—

(1) Có-shuidheanna do ghairm;

(1) Summoning of Joint Sittings;

(2) Có-choistí do thionscnamh;

(2) Initiation of Joint Committees;

(3) Caoi do thabhairt do bhaill gach Tighe ar chuaird do thabhairt ar an dTigh eile agus labhairt agus ceisteanna d'fhreagairt i dtaobh Billí ina mbeadh suim acu;

(3) Facilities for members of either House to visit the other House, and to speak and answer questions on Bills in which they are interested;

(4) An tslí chun Billí Airgid do dheimhniú; agus

(4) Manner of certifying Money Bills; and

(5) An tslí chun deighleáil le Billí Príobháideacha.

(5) Method of dealing with Private Bills.

Tar éis d'úr gCoiste-se na tairisgintí sin do bhreithniú, do chinneadar a mhola don Dáil go ndéanfaí atharú ar Bhuan-ordú le n-ar ghlac an Dáil an 8adh lá de Mhárta, i dtreo go ngairmfadh an Ceann Comhairle Có-shuidheanna tar éis dul i gcomhairle le Cathaoirleach an tSeanaid. Cuid de sna nithe do pléadh níor réidhtíodh le n-a chéile ina dtaobh. Do haontuíodh tuille cruinnithe do bheith ann ar phuinti nár socruiodh.

Your Committee, having taken these proposals into consideration, decided to recommend to the Dáil a change in a Standing Order adopted by the Dáil on the 8th March, whereby Joint Sittings will be summoned by the Ceann Comhairle after consultation with the Cathaoirleach of the Seanad. Agreement was not reached on some of the matters discussed. It was agreed that further meetings would be held on outstanding points.

Your Committee think that the present position of the Standing Orders, in so far as they deal with public business, justify their publication in book form. They suggest that the Constitution should be included, for many of the Orders are intelligible only by reference to it. They recommend accordingly that the Dáil authorise that the Standing Orders be edited and indexed and brought out in the form indicated.

In addition to the Joint Meeting referred to above, the Committee met on five occasions since submitting their last Report.

That report is signed by the Ceann Comhairle, and in the Schedule is set out the proposed new Standing Orders, or rather the new Orders that are suggested for the acceptance of the Dáil. The first group consists of four Orders dealing with the election of a Ceann Comhairle in the new Dáil. The first proposal in the Standing Order is: "On the first day of the meeting of Dáil Eireann subsequent to a General Election the proceedings shall be opened by the Clerk at the Table reading the Proclamation convening Dáil Eireann."

I wonder would it meet the convenience of the Deputies better if we took the Report as read a second time, and went into Committee on the Schedule? I do not know if Deputies are desirous of discussing the Orders in detail.

I move that the Report be received and taken into consideration in Committee.

Is the motion, "That the Report be received," or "That the Report be received and discussed in Committee"?

I think it would be undesirable to discuss it in Committee to-day. Consideration of it should be postponed to another day.

Very good. Shall we receive the report for consideration to-day, and put down the consideration of the Schedule for the first day after the adjournment?
