Vol. 6 No. 31

JURIES (AMENDMENT) BILL, 1924—FIFTH STAGE.

I move that the Bill do now pass. Since the Report Stage I have been considering the particular point raised by Deputy Johnson with regard to Section 4. The Deputy questioned whether it was not worded rather too widely, and on that occasion —the Report Stage—I doubted whether any amendment was necessary. Since then I have looked further into the point, and taken advice upon it, and I am now of opinion that at least it is advisable to remove any doubt by altering the wording of that Section. The Section, as it stands, reads: "In addition to the persons now disqualified for serving on juries, any person who is not registered as a Dáil or Local Government elector shall be absolutely disqualified from serving on any Jury, Inquest, or Enquiry whatsoever." The amendment which I have drafted would delete the words "Inquest or Enquiry whatsoever," and would insert after the word "Jury" the words "or Inquest other than an Inquest held by a Coroner by virtue of his office." That may be held to be more than a verbal amendment allowed at this stage of the Bill, and if that is so I would undertake to have it moved in the Seanad.

I have not seen the amendment, and, therefore, cannot give a ruling on it. It cannot be taken now.

Mr. O'HIGGINS

Very well; I move "That the Bill do now pass."

I do not want to divide the House on this motion, but I would like to have it recorded that I voted against the Bill.

Question put and declared carried.
