DAIL EIREANN FUNDS.

In a case at present before the High Court of Justice, of Fogarty and others against Donoghue and others, concerning certain funds, the Clerk has been asked on behalf of the plaintiffs to produce all documents in his possession relating to matters in controversy in this action, including:—

Resolution of Dáil Eireann, 19th June, 1919, re Trust Deed.

Resolution of the 29th June, 1920, re appointing Trustees.

Resolution of the 10th May, 1921, re 1921 election.

Resolution of the 26th August, 1921, appointing Trustees.

Resolution of the 14th September, 1921, appointing Plenipotentiaries to negotiate the Treaty.

Resolution of the 7th January, 1922, ratifying the Treaty.

Resolution of the 1st March, 1922, re Trust Account.

Resolution of the 20th May, 1922, re 1922 election.

Agreement of the 20th May, 1922, Collins and De Valera.

Resolution of the 9th September, 1922, appointing President Cosgrave Minister of Finance.

Resolution of the 13th September, 1922, appointing new Trustees; and Resolution of the 20th September, 1923, appointing Mr. Ernest Blythe Minister of Finance.

In the case of the documents specified I desire an order that the Clerk should be authorised to produce them. A further application has been received to produce on behalf of the defendants the minutes, records, decrees, proclamations and proceedings of (a) the First Dáil Eireann, (b) the Second Dáil Eireann. As this application is not sufficiently specific to identify the documents required a similar order cannot be made. I suggest that authority should be given for the production of the documents specified.

May I suggest that this is a matter which might well be considered by the Committee on Privileges before any decision is taken in the Dáil?

It would be, perhaps, a matter that should be considered by the Committee on Privileges, but the case is coming on tomorrow, and I am not clear that any question arises, except that the Dáil should be informed and authority got for the production of any documents in this particular case. Another question arises as to the authority for the production of such documents during a Recess. A meeting of the Committee on Procedure could not be held, I think, until possibly Thursday morning, when the general question could be discussed. Unless some objection is raised I think that in this case we might give the documents that are specified.

I move that permission be given for the production of the documents specified.
