CEISTEANNA.—QUESTIONS. [ORAL ANSWERS.] - MOTOR COLLISION WITH PONY AND TRAP.

asked the Minister for Defence if he is aware that on November 29th, 1923, a military motor car dashed into and smashed a trap and injured a pony and driver on the Lucan Road, the property of Mrs. Elizabeth Dempsey, 8 Upper Gloucester Street; that her claim for damages has been rejected, the Military Authorities informing her that they have no legal liability in the matter and that her claim cannot be admitted as a charge against Army Funds; and if, in view of the hardship of this decision, he will reconsider this and similar cases, with a view to granting compensation.

I am aware that a military motor car collided with a pony and trap, the property of Mrs. E. Dempsey, on the Lucan Road on the 29th November, 1923. The circumstances of the accident were duly enquired into, and it was found that the occurrence was due to negligence on the part of the driver of the trap in not having a light displayed on the trap. It is not practicable to reconsider the decision already given on the claim for damages in this or other similar cases.
