CEISTEANNA—QUESTIONS. ORAL ANSWERS. - CLAIM BY CLARE CO. COUNCIL.

asked the Minister for Finance if he is aware that the Clare County Council has not had as yet refunded to it by his Department the sums paid out by it in the years 1919 and 1920 in respect of decrees for Criminal Injuries to persons and property and if he is further aware that another sum of £590 15s. 11d. due to the Council in respect of Poor Rates was garnisheed and has not become available to the Council, and if he can state whether payment of the gross amount of £10,014 2s. 2d. can be expedited.

The question of the refund to certain local authorities, including the Clare County Council, of the amounts paid by them on foot of decrees awarded in respect of criminal injury to the person and property is at present being investigated by my Department and forms part of an adjustment which is being effected with the British Government. It has not been found possible to dispose of the matter earlier because of the fact that the apportionment of liability between the Saorstát and British Governments has been difficult to ascertain. Further, the matter is complicated by the fact that there are certain local authorities from whom refunds are due on foot of decrees awarded in respect of injury or damage done prior to the 21st January, 1919. In such cases the local authorities concerned are liable for the amounts of the decrees. These decrees have been discharged by the British Government and have to be taken into account in the adjustment referred to above which clearly can only be dealt with as a whole. Considerable progress has, however, been made with the adjustment and it is hoped that the matter will be finally disposed of at an early date.

As regards the sum stated to be due to the Council in respect of rates garnisheed, the adjustment of this matter cannot be completed until the sums withheld in this way by the Great Southern and Western Railway Company have been duly recovered during the discharge of the compensation awards recently made in favour of the Company.
