Vol. 13 No. 11

WRITTEN ANSWERS. - RESIGNED POLICEMAN'S APPLICATION FOR PENSION.

asked the Minister for Finance if he will state the grounds on which he based his refusal to grant a certificate under Section 5 of the Superannuation and Pensions Act, 1923, to Mr. Patrick F. Cullen, of 14 Palmyra Park, Galway, who was a member of the R.I.C. for 14½ years, and who, it is stated, resigned on account of his national sympathies in October, 1920.

When I came to decide on the application made by Mr. Cullen for a pension under the Superannuation and Pensions Act, 1923, I found that he had already resigned from the Gárda Síochána. I felt bound, therefore, to regard him as having been offered and having rejected suitable employment within the meaning of Article 4 of the R.I.C. (Resigned and Dismissed) Pensions Order, 1924. I should in any event have felt obliged to declare forfeited under the power conferred on me by Article 2 of Part II. of the Schedule to the Order any pension that might have been awarded to him under the Act. In these circumstances, after the most careful consideration of all the facts in the case, I have felt unable to authorise the grant of a pension.
