Vol. 14 No. 19

WRITTEN ANSWERS. - UNEMPLOYMENT BENEFIT APPLICATION (MOATE).

SEAN O LAIDHIN

asked the Minister for Industry and Commerce if he will state why unemployment benefit has been refused to James Conlon, Farnagh, Moate, Westmeath, who is a road-worker in the Westmeath County Council; if he is aware that the claimant was granted benefit from November 10th, 1925, by the Board of Referees sitting in Athlone, but was refused by the Umpire, and if he will have this case re-investigated with a view of granting benefit.

James Conlon, Farnagh, Moate, claimed unemployment benefit on the 10th November, 1925. His claim was disallowed by the Insurance Officer on the grounds that he was not unemployed and not unable to obtain suitable employment. Mr. Conlon appealed to the Court of Referees against this decision and the Court recommended that his claim should be allowed. The Insurance Officer was, however, unable to agree with the recommendation of the Court and accordingly referred the case to the Umpire, who decided that the claim should be disallowed. The decision of the Umpire is final and the case cannot be re-opened excepting on the production of material facts which were not before the Umpire when he gave his decision.
