CEISTEANNA.—QUESTIONS. ORAL ANSWERS. - COMPENSATION CLAIM (CO. WESTMEATH).

asked the Minister for Defence if he will state the present position of the claim of Mr. Patrick Daly, Castletownbrack, Castledaly, Westmeath, in respect to severe injuries to himself, and to damages to a pony and cart, his property, through a collision with a military motor at Ballykeeran Cross, Westmeath, on the 18th February, 1924; if he is aware that Mr. M.J. Keane, Solicitor, acting for the claimant, was notified on the 9th June, 1925, that a Court of Enquiry was to be held concerning the case, in Custume Barracks. Athlone, on the 18th June, 1925, when Mr. Daly could attend with witnesses; that claimant was subsequently notified from Headquarters, Western Command, on the 16th June, 1925, that the proposed Court of Enquiry was indefinitely adjourned, and that his attendance was unnecessary; and whether enquiries in this case will be expedited.

Mr. Daly's claim has been considered without its being necessary to hold a Court of Enquiry in the matter. It has been ascertained that the driver of the military motor was not to blame for the accident. In the circumstances the claim cannot be entertained as a charge on Army funds.

Was Daly notified as to the military inquiry?

Yes, he was notified that it was not being held.

He was notified that an inquiry would be held and he was further notified that an inquiry would not be held, and consequently he did not attend to give evidence. Has Daly any power now to take proceedings even against the driver of the car?

That is a legal question and he will be advised by his solicitor in that matter, I am sure.
