CEISTEANNA—QUESTIONS. ORAL ANSWERS. - DONEGAL COMPENSATION CLAIM.

asked the Minister for Finance why compensation was refused to Mr. Jim Kelly, Frosses, County Donegal, for injuries received from the Black and Tans, who took him from his home on April 17th, 1921, and assaulted him, inflicting on him severe injuries; and further, whether the Minister is aware that compensation was paid to others in the area who lodged claims at the same time.

After the fullest consideration in the light of all the information before me, I came to the conclusion that the circumstances in this case did not justify payment of compensation. With regard to the last part of the question, I would inform the Deputy that every claim for compensation was considered and decided on its own merits.

Is the Minister aware that this man was a captain in the I.R.A. and that he was totally incapacitated for eighteen months after receiving these injuries?

I am not aware that he was incapacitated for that period.

Is the Minister not aware that there were doctors' certificates submitted to the effect that this man was incapacitated for eighteen months?

There was a certificate submitted to the effect that he was suffering from an injury to the shin, but I am not aware that he was incapacitated for eighteen months and unable to work.

Will the Minister reconsider this case?

Well, the only thing I can say is that I will undertake to look into the facts again.
