asked the Minister for Defence if he will state why a claim, made under the Army Pensions Acts, 1923 and 1927, by Mr James Coffey, Shanballymore, Donohill, County Tipperary, was disallowed.

Mr. Coffey was examined by the Army Pensions Board in connection with his claim for pension under the Army Pensions Act, 1927. The Board found that the claimant was suffering from two different disabilities, only one of which could be attributed to service. As the degree of disablement in respect of this latter disability had not reached the minimum degree of disablement required by the Act at the date of examination by the Army Pensions Board, no pension could be awarded, and the applicant has been so informed.

Can the Minister state what the degree of disablement was in this case?

From which disability?

From disability arising out of his service.

I think it is 100 per cent. disability, but not 50 per cent. disability out of service.

Does the Minister consider that a man who has 50 per cent. of disability as a result of service given to this country is not entitled to a pension, in view of the fact that people who have suffered no disablement are in receipt of pensions?

I am governed by the Act.

Will the Minister consider amending that Act?
