WRITTEN ANSWERS. - KILTIMAGH COMPENSATION CLAIMS.

asked the Minister for Finance whether Mrs. B. Nicholas, Mrs. Staunton and Mr. Thomas P. Staunton, of Bohola, Kiltimagh, Co. Mayo, have made a claim for compensation for the seizing of their furniture by armed men during the civil war; whether Judge Doyle made a report of £37 10s. 0d. and £4 6s. 3d. costs on the claim on the 13th February, 1924; whether it has been decided to make no payment on foot of this report, because the Minister was not satisfied that the claim came within the meaning of the Act; and whether the Minister will state the grounds on which this decision was based.

In this case, the judge made a report under Section 15 of the Damage to Property (Compensation) Act, 1923, recommending payment of £19, with £4 6s. 3d. costs. As a result of inquiries which were made after the receipt of the judge's report, I came to the conclusion that the applicants had not suffered a loss for which compensation could properly be paid, having regard to the terms of Sections 9 and 15 of the Act.
