Dáil Éireann díospóireacht -
Wednesday, 29 Nov 1933

Vol. 50 No. 4

Injuries to Property Acts and Damage to Property Act, 1933. - Rules of Procedure.

I move:—

Go gceaduíonn an Dáil leis seo na Rialacha Nósimeachta i dtaobh Cúitimh i nDíobháil do Mhaoin fé sna hAchtanna um Dhíobháil Choiriúil agus fén Acht um Dhíobháil do Mhaoin (Cúiteamh) (Leasú), 1933, do leaghadh ar Bhord na Dála an 29adh lá de Mhí na Samhna, 1933, agus go mbeartuíonn le rún é do bheith oiriúnach na Rialacha san do theacht i bhfeidhm an ladh lá d'Eanar, 1934.

That the Dáil hereby approves of the Rules of Procedure as to Compensation for Injuries to Property under the Criminal Injuries Acts and the damage to Property (Compensation) (Amendment) Act, 1933, which were laid on the Table of the Dáil on the 29th day of November, 1933, and resolves that it is expedient that the said Rules shall come into operation on the 1st day of January, 1934.

These rules are formal and complementary to the rules that were made under the Principal Act. The date of the coming into operation of the rules has been fixed for 1st January next in order that practitioners and other persons interested might have due notice of the rules and might have an opportunity of making themselves acquainted with them.

I take it that these rules have been the subject of discussion between the Minister's Department, the legal profession and the judiciary?

Not these rules to any extent because these are only complementary to the rules already in existence. They are absolutely formal and they do not override in any way the rules that have been made under the Principal Act.

Question put and agreed to.
