Ceisteanna—Questions. Oral Answers. - Clare Right of Way.

Mr. P. Hogan

asked the Minister for Lands if he will state when it is proposed to complete arrangements to provide John Neylon, Ballyduffmore, Kilnamona, Ennis, County Clare (R.O. No. 385/47) with a right of way to his holding at above address.

The completion of the proceedings to provide a right of way for John Neylon across the holding of John Power has been delayed through objections raised by the parties at various stages of the proceedings. After considering these objections, the Land Commission have approved the making of a fresh order under Section 43 of the Land Act, 1923, and Section 39 of the Land Act, 1931, but another objection thereto has been lodged by John Power. This objection will be listed for hearing by the Land Commission as soon as possible, and after its disposal it is hoped that a final order can be made, providing the required right of way.

Mr. Hogan

Is the Parliamentary Secretary not aware that this particular case has been under consideration for some four years at least and that this man is suffering great hardship owing to the fact that he has been unable to get into his farm because of the absence of this right-of-way?

I am aware that there has been considerable delay in dealing with this matter. One of the parties, Power, has utilised every means which the law provides for the purpose of holding up the making of this right-of-way but until his objection is disposed of by the courts no further action can be taken.
